Proposed Imposition of Civil Penalty in the amount of Two Hundred and Tw y

Five Thousand Collars ($225,000) will be issued on or about October 19, 7

to Florida Power end Light Company.

The Order confirms the licensee's alan to

have an independent third party review activities at Turkey Point and t1e 1

company's corporate offices to determine the root causes of the facility's j

poor past performance. Further, the Order directs the licensee to put in i

place a corporate operations audit program until the results of the independent q

appraisal have been received.

The Notice of Violation and Proposed Imposition of Civil Penalty is based on three violations including (1) loss of emergency boration flow paths for b0th units because of the failure of operations personnel s

to use or follow approved procedures, (2) isolation of the backup nitrogen system for the Unit 4 Auxiliary Feedwater System flow control valves for approximate.ly 20 hours2.314815e-4 days <br />0.00556 hours <br />3.306878e-5 weeks <br />7.61e-6 months <br />, again due to failure to follow approved procedures, and (3) operation of the Unit 3 Intake Cooling Water System outside the plant design basis because of poor communications among members of the plant staff.

I It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.

Followirg,NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
