Dear Mr. Cooper:

Thank you for your letter of January 21,1998 responding to our review of the final Kansas 10 CFR Part 20 equivalent regulation. We appreciate the actions you are taking to address our comments and ask that you provide us an opportunity to review any proposed and final changes that are made to your regulations. As requested in All Agreement States Letter SP-96-027,"Reauest to Hiahlioht Chanoes to Aareement State Reaulations Submitted to NRC ,

for Comoatibility Review" (March 1,1996), please highlight the changes in the regu!ations and send one copy in a computer readable format, if possible.

In your letter of January 21,1998, you asked us to provide the rationale for the comment that 5e Kansas Regulation 28-35-219a(g)(3)(B), which is to be equivalent ' NRC 10 CFR 20.1905(b), should reference Table lli of Apper. dix B of the Kansas regulation with regard to labeling containers. (Note that Table lli corresponds to Table 3 of Part 20.)

Although Table 3 of Appendix B establishes monthly allowable concentrations for release to sanitary sewers, Table 3 is also referenced and used as a basis to define quantitative limits to exempt a licensee for labeling containers of licensed material in 20.1905(b). The rationale for use of the Table 3 limits to exempt licensees from the container labeling requirements is based on the assumptions used to derive the concentrations limits in Table 3. The concentrations for this table were derived by taking the most restrictive occupational stochastic oral ingestion annual limit on intake (All) and dividing by 7.3 x 10E6 ml, which is composed of the annual water intake for? Reference Man" (7.3 x 10E5 ml), and a factor of 10 (to go from 5 rem to 0.5 rem), such that a sole water source with this concentration would result in a committed effective dose equivalent of 0.5 rem. (See Discussion in Appendix B to Part 20, Paragraph labelled:

Table 3 " Sewer Disposal.")

- This gives the rationale of where these concentrations are derived from and what they i represent. . Although a separate table could have been developed and included in Part 20 to if' exempt containers of licensed material from the labeling requirement, staff believed use of the Table 3 values provided an acceptable level of protection, and eliminated the need to include an additional separate Table in Part 20. Thus, if an untabeled container of licensed material at the Table 3 concentrations were to be inadvertently ingested, the resulting dose would be a fraction of the 0.5 rem committed dose.

We appreciate the opportunity to respond to the draft comments of the Kansas final Pan 20 rule.

After careful review of the comments and discussion with Mr. Steve Salomon of your staff we offer the following responses:

The comment regarding the definition of"Special nuclear material in quantities not sufficient to form a critical mass" is noted. The omission of the dividing lines will be corrected in the next revision of this definition. Until the revision is finalized, this typographical error will be corrected through specific license condition where appropriate.

Subsection 28-35-217a(c) is interpreted by this office as eliminating the 10 percent cut off for '

monitoring of extremities. This is overly conservative and adds unnecessary confusion to the regulation, it is our intention to eliminate this subsection in the next revision of this regulation.

The comment on Kansas Regulation 28-35-219a(g)(3)(B)(NRC 10 CFR 20.1905(b)) indicates we should reference " Table III of Appendix B" with regard to posting containers. " Table III of Appendix B" refers to the monthly concentrations allowable to be released to sewer systems not to containers. While we have no objection to using this as a concentration limit for labeling containers (and will incorporate it in the n' ext revision) please provide the rational for this comment. This information will assist us in understanding the thought process behind the regulation and aid in consistent enforcement. ,

The other comments discussed in Enclosure 3 involve inadvertent omissions, typos or errors. We appreciate you bringing these to our attention and plan to correct these with the next revision of the Kansas Regulations. Please note the exact wording of these changes is subject to review by the State l Legislature and Legal Representatives.

' The purposes of 10 CFR 20.1905(b) is addressed in the Trai g Manual for 10 CFR Part 20 (Enclosure 1). The Explanation states: '

If the concentration of radioactive materialin a ntainer is less than the values specified in Appendix B, Table 3 entitled, "Re ses to Sewers," the container does not have to be labeled.

Also, Regulatory Guide 10.8, Appendix X (Enci ure 2) states:

Licensees are not required to label ntainers holding licensed material in concentrations less than those s cified in Table 3 of Appendix B to 20.1001-20.2401.
