Dear Mr. Longtoe Sheehan:
Governor Philip Scott, on behalf of the State of Vermont, has submitted a request that the U.S.
Nuclear Regulatory Commission (NRC) enter into an Agreement with the State under Section 274 of the Atomic Energy Act of 1954 (AEA). Under the proposed Agreement, the Commission would discontinue, and the State of Vermont would assume, regulatory authority within the State over byproduct material as defined by Sections 11e.(1), 11e.(3) and 11e.(4) of the Act, source material and special nuclear material less than critical mass quantities at 36 academic, commercial and medical facilities across the State. These regulatory responsibilities would be transferred to the State of Vermont and the States regulatory requirements for radioactive materials would apply instead of NRC requirements. The NRC would continue to regulate the use of radioactive material at federal facilities within the State and the Vermont Yankee Nuclear Power Plant. After the Agreement goes into effect, licensing actions taken by the State of Vermont will be subject to the States environmental and historic preservation laws, not federal laws such as the National Environmental Policy Act or the National Historical Preservation Act.
