Dear Dr. Lipoti:

This letter responds to your comments dated October 12, 2007, on behalf of the New Jersey Department of Environmental Protection, regarding the recent hearing conducted by the Atomic Safety and Licensing Board (ASLB). This hearing was held in Toms River, NJ and was specifically conducted to allow the ASLB to question witnesses who had provided testimony concerning the sandbed region of the Oyster Creek drywell shell.

The Nuclear Regulatory Commission staff is awaiting the decision of the ASLB and therefore cannot comment on potential decisions of the Board.
