REMARKS Action authorized to support DOE Project No. 71368A Consistent with the Department of Energy's (DOE) full cost recovery policy, DOE collects, as part of its standard indirect cost rate, a Laboratory Directed Research and Development (LDRD) cost. TASK ORDER STATEMENT OF WORK (SOW) 1. PROJECT TITLE NRC-HQ-25-14-0-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 "Update of Decommissioning Generic Environmental Impact Statement (GEIS)" 2. BACKGROUND NUREG-0586-Generic Environmental Impact Statement on Decommissioning of Nuclear Facilities, (Decommissioning Generic Environmental Impact Statement (GEIS)), is relied upon by the Office of Nuclear Reactor Regulation (NRR), New Reactors Office (NRO) and Nuclear Materials Safety and Safeguards (NMSS) for National Environmental Policy Act (NEPA) reviews for reactors.
The GEIS was last updated in 2002, following a rule change in. 1996. In addition to another rulemaking related to decommissioning currently underway, there are numerous conclusions and issues that need to be updated in the GEIS (Continued Storage, recent decommissioning experience, etc.). 3. PROJECT DESRIPTION AND OBJECTIVE(S)
The objective of this project is to update the GEIS, which will require completion of NEPA/GEIS milestones
-scoping, preparation and publication of a Draft GEIS, support during public meetings and comment period including resolution of comments, and finalization of the GEIS and Record of Decision (ROD). Pacific Northwest National Laboratory (PNNL) will support the NRG by developing a Draft and Final GEIS that the NRG will use to document its generic environmental review of nuclear reactor decommissioning.
The resource/impact areas to be examined in the GEIS, in terms of the affected human environment and the potential impacts to that environment, will include: land use; transportation; geology, seismology and soils; water resources (ground water and surface water); ecological resources (including threatened and endangered species);
climatology; meteorology and air quality; climate change; noise; historic arid cultural resources; visual and scenic resources; socioeconomics; public and occupational health (non-radiological and radiological);
environmental consequences from accidents; waste management; and environmental justice. PNNL will also evaluate the existing scope, purpose and need, and alternatives associated with decommissioning nuclear reactors.
Decommissioning is likely to generate significant external stakeholder interest from around the country. Development of the GEIS will require a comprehensive and robust public outreach and facilitation program. PNNL will prepare the GEIS in accordance with the NRC's applicable NEPA-implementing regulations in 10 CFR Part and NUREG-1555 (Environmental Standard Review Plan (SRP)). In addition, the NRG typically coordinates reviews required by other statutes such as the National Historic Preservation Action (NHPA) and the Endangered Species Act (ESA) with its NEPA reviews. Therefore, PNNL will be cognizant of other statutes that the NRG will need to comply with during its NEPA review. 1
- 4. DELINEATION OF TASKS N RC-HQ-25-14-D-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 The Statement of Work (SOW) for this Task Order falls within the scope of the EWA with
- PNNL, NRC-HQ-25-14-D-0001.
The specific tasks and deliverables required for PNNL to support the scoping process, complete the Draft and Final GEIS and ROD, and assist with associated consultations, are described in detail below. Section 6 of this proposal lists the anticipated deliverables and the milestone schedule.
Section 11.1 lists the assumptions related to required travel for this task order. Task 1 -Project Management This task will last for the entire duration of the GEIS update. It may involve travel for the PNNL Task Team Lead (TTL) to meet with the NRG Contracting Officer's Representative (COR), if necessary.
Subtask 1. 1 Communication The PNNL TTL will have a weekly status call or face-to-face meeting with the NRG COR to discuss the status of the project (e.g., technical issues, contract monitoring, file. management, etc.). Communication may be more or less frequent depending on the need. Subtask 1.2 File Management PNNL will use the EARRTH collaboration/production site for file management.
EARRTH will be accessible by all PNNL project team members and contain project-related documents, correspondence, and all working and final files. NOTE: Project setup and maintenance fees associated with the EARRTH collaboration/
production site will be funded by NRC Agreement No. NRC-HQ-41 D-0002, "Technical Assistance for the Development of Environmental Assessment Reactor Review Team Home (EARRTH) Tool for NMSS Environmental Reviews and Rulemaking Activities." Subtask 1.3 QualitvAssurance Program The PNNL TTL will have overall responsibility for ensuring that a robust and comprehensive quality assurance program is adequately implemented.
The PNNL TTL will ensure that all deliverables have been prepared in accordance with quality assurance standards arid that all deliverables are reviewed for adequacy, accuracy, and consistency in technical content. Task 2 -Review of GEIS As the initial step in the GEIS development, PNNL will review the existing scope, purpose and need, and identify proposed actions and reasonable alternatives associated with the GEIS. 2 Subtask 2. 1 Review of Relevant Documentation N RC-HQ-25-14-0-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 PNNL will review the Continued Storage GEIS (NUREG-2157) to determine how much information can be used for the Affected Environment and Cumulative Impacts Analysis.
PNNL will review available decommissioning activities at decommissioned (all phases) nuclear power plants and their environs.
PNNL will independently collect available data or other types of information that will include, references cited in licensee's documents and relevant documents found through a comprehensive search and utilization of the NRC's publicly available Agency-Wide Documents Access and ManagerT)ent System (ADAMS), found at http://www.nrc.gov/reading-rm/adams.html.
Subtask 2.2 Identify Applicable Laws and Regulations With prior approval of the NRC COR, PNNL will include in its GEIS development process, any additional coordination necessary to cover laws and regulations, other than NEPA. In addition, as necessary to" the development of the GEIS and as requested by the COR, PNNL will provide support for NRC consultations,.
i.e., Section 106 consultation of the NHPA and Section 7 consultation under the ESA, as well as support for NRC coordination with other Federal, State, and local agencies.
This support may include identification of agencies to contact, providing supporting information/documentation for consultations/coordination, input to and review of NRC letters/emails to agencies, etc. PNNL will compile a list of federal, tribal, state, and local statutes, laws, and permits that are applicable to decommissioning projects, as appropriate, with an accompanying short description of each statue, law, or permit. Information resulting from NRC's past consultations/coordination with other agencies will be provided to PNNL for use in the Draft and Final GEIS analyses, as well as for summarizing, referencing, and reproducing, as necessary, in the Draft and Final GEIS documents.
Although PNNL will endeavor to conduct the bulk of the required information collection and review at the outset of the project, PNNL will continue to collect and review information throughout the duration of the project. Additional information may be identified or otherwise become available to support the development and completion of the Draft and Final GEIS and to provide support for a potential adjudicatory hearing on environmental issues. Coordination and discussions between PNNL and the NRC staff are also expected to be ongoing, as necessary, throughout the duration of the task order. Subtask 2.3 List all Documents Collected PNNL will also develop and maintain a bibliographic listing of all documents collected (reports, maps, papers, data files, etc.), including ADAMS Accession Numbers or web links where applicable, and will also maintain on file electronic copies of all collected documents.*
All references ultimately cited in both the Draft and Final GEIS (cited references and maps, drawings, tables, etc.) must be already publicly available in ADAMS or elsewhere in the public record or can be made publicly available in ADAMS. 3 NRC-HQ-25-14-D-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 PNNL will make the document list and electronic copies of documents, including periodic updates, available to the NRG GOR upon request. PNNL will be responsible for obtaining and providing the NRG GOR with appropriate permissions for use of any copyrighted materials and reference documents in the Draft and Final GEIS. Task 3 -GEIS Scoping Process PNNL will assist the NRG staff in preparing for, organizing, and implementing the GEIS scoping process. PNNL will also support the NRG staff during other information gathering meetings with federal, tribal, state, and local organizations, public interest groups, and members of the public. Subtask 3. 1 -Scoping Meetings PNNL will attend and support the GEIS scoping meeting(s) for the project. The scoping meeting(s) will be attended by PNNL's TTL and up to two (2) PNNL technical staff members (subject matter experts). PNNL's meeting attendees will be determined in consultation with the NRG GOR in advance of the scoping meeting(s).
Up to four (4) public scoping meetings will be held by the NRG during the public scoping comment period. In addition, PNNL may be requested by the NRG GOR to provide support in preparing meeting materials (NRG presentation, handouts, etc.) and to assist the NRG staff in the preparation of anticipated questions and responses to those questions, as well as other materials for the meeting(s).
PNNL may also be requested to provide logistical support for scoping meetings, including securing venues for the meetings, open-house venues and equipment, audio visual support for the meetings, as appropriate, and assisting NRG with coordinating other logistical aspects of the meetings both before and onsite during the meetings.
NOTE: In this proposal, PNNL assumed labor hours and approximate costs of four (4) venues using standard audio/visual support (based on prior experience). PNNL will propose modifications to this subtask should additional venues be needed, or should the cost of the venues exceed this estimate.
Subtask 3.2 -Support and Facilitation for Scoping Meetings PNNL will provide support and facilitation for the draft scoping meetings, as needed. As directed by the NRG GOR, PNNL will identify and communicate with local stakeholders or key national stakeholders in advance of the meetings to ensure that appropriate parties are included in information distribution, notified of meetings and project activities, and met with, if appropriate.
As directed by the NRG GOR, PNNL will provide a skilled facilitator for the meetings to ensure that they are conducted in an orderly and productive manner. The facilitator, *either a PNNL staff member or consultant, will have direct experience facilitating contentious NRG meetings on environmental and high-level waste storage and transportation topics. PNNL will assume support for and facilitation of four (4) total meetings, including preparation time, attending preparation meetings, attending and facilitating the public meetings, and providing meeting support. 4 Subtask 3.3 -Scoping Summarv Report N RC-HQ-25-14-0-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 PNNL will manage the comments received during the public scoping process. PNNL will identify, sort and bin, review, and analyze all public comments presented at the scoping meeting(s) and otherwise provided to the NRG during the GEIS scoping process. PNNL will prepare a Scoping Summary Report to satisfy the requirements of 10 CFR § 51.29(b).
The Scoping Summary Report will be submitted to NRG COR according to the schedule provided in Table 1 of this SOW.
- PNNL will support the NRG COR in resolving comments received during the NRG concurrence review (OGG, interoffice).
The NRG expects to receive up to 20,000 pieces of correspondence and no more than 1,000 unique comments.
If more than 1,000 unique comments are received, the NRG and PNNL will discuss the need to increase the level of effort (See Optional Subtask 3.4). PNNL will prepare a stand-alone Scoping Summary Report to be issued as a separate document to all commenters.
PNNL will support the COR in preparing a mailing list for the Scoping Summary Report. ) (OPTIONAL)
Subtask 3.4 -Additional Level of Effort for Large Numbers of Scoping Comments Under this optional subtask, PNNL, in coordination with the NRG COR, will provide additional support to address more than 1,000 unique comments.
The level of effort will be determined at the time this optional subtask is exercised.
Task 4 -Prepare Draft GEIS PNNL will plan, draft, and complete a Draft GEIS that will document the NRG staff's evaluation of the potential environmental impacts of reactor decommissioning.
Prior to submission to the NRG, PNNL will review all versions of the GEIS for adequacy, accuracy, and consistency in technical content. In addition, reviews of the Draft and Final GEIS will be conducted by the PNNL's technical editor. The Draft and Final GEIS will read as if written by a single author, rather than seeming to be a compilation of individual articles written by multiple authors in differing styles. PNNL will provide a Draft GEIS that is consistent with 1 O CFR Part 51. Subtasks involved in the preparation of the Draft GEIS by PNNL will include preparation of a revised annotated GEIS outline, a revised purpose and need, and a revised description of the proposed action and alternatives, and preparation of all other preliminary draft chapters/sections of the GEIS. Subtask 4. 1 -Preliminarv Annotated GEIS Outline PNNL will develop a "Preliminary Annotated GEIS Outline" for use in developing the GEIS. The annotated outline will concisely describe:
(1) the anticipated scope of each GEIS section; (2) the purpose and need; (3) the proposed action and reasonable alternatives; and (4) how much can be incorporated by reference or used for the Affected Environment from previous reactor GEISs (such as License Renewa'.I or Continued Storage GEISs). 5 N RC-HQ-25-14-D-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 The applicable requirements of 10 GFR § 51.70-51.71, and of Appendix A to Subpart A of 10 GFR Part 51 (Format for Presentation of Material in Environmental Impact Statements) will be incorporated into the outline. PNNL's goal in developing the outline will be to focus the GEIS discussion on areas of true environmental concern and the resources that will be most affected by decommissioning activities.
PNNL will submit the Preliminary Annotated GEIS
- Outline to the NRG GOR, and the NRG will review the outline and provide comments, as needed, to PNNL. Subtask 4.2 -Preliminary GEIS Purpose and Need. Proposed Action. and Alternatives A clear agreement between the NRG and PNNL on the GEIS's purpose and need, the proposed action and alternatives to be considered is critical to the efficient preparation of the GEIS. To facilitate this agreement, PNNL will prepare and provide the NRG GOR with the (1) "Preliminary GEIS Purpose and Need," and (2) "Preliminary Description of the Proposed Action and Alternatives," for use in developing the GEIS and for possible use in Subtask 3. The GOR will provide comments on PNNL's submittal.
Subtask 4.3-Preliminary Assessment of Generic Impact Determinations PNNL will prepare a preliminary determination on what. resource areas can be generically resolved.
The following resource/impact areas should be considered:
land use, transportation, geology, minerals and soils, water resources (groundwater and surface water -water use and water quality), ecological resources, special status species and habitats, air quality, climate change, noise, historic and cultural resources, visual and scenic resources, socioeconomics, public and occupational health (non-radiological and radiological), accidents, waste management, and environmental justice. The length and level of detail of the description of the impacts for each resource area should be informed by the significance of the impacts to that resource area. For the impact discussion for resource areas other than environmental justice, historic and cultural resources, and threatened and endangered species, PNNL will make use of the impact significance levels (SMALL I MODERATE I LARGE). The focus of the impact evaluation for those resource areas is to be on the important attributes of the resource and whether the environmental effects alter and separately destabilize those attributes.
For environmental justice, historic and cultural resources, and threatened and endangered species, PNNL will use the impact wording specific to those resources (e.g., "disproportionately high and adverse impact," "adversely effect," "adversely affect).
Subtask 4.4 -Preliminary Draft GEIS PNNL will prepare and provide the NRG GOR with a Preliminary Draft GEIS in accordance with the NRG's Notice of Intent to Prepare a GEIS and the NRG-approved Revised Annotated GEIS Outline from Subtask 4.1. A copy of the Preliminary Draft GEIS also will be placed and maintained on EARRTH. 6 N RC-HQ-25-14-D-0001 N RC-HQ-50-17-T-0001 Attachment No. 1 The material developed in Task 2, Subtasks 3.2, 4.1, 4.2, and 4.3 will be incorporated into the Preliminary Draft GEIS. PNNL will also develop and provide all additional materials necessary for a complete Preliminary Draft GEIS including, but not necessarily limited to: GEIS introductory information; a description of the purpose and need for the proposed action; a description of the scope of the analysis in the GEIS; information on applicable statutory and regulatory requirements, permits and consultations; mitigation measures to avoid or minimize the impacts, as appropriate; and a summary of environmental consequences.
Subtask 4.5 -Writing Session for the Preliminarv Draft GEIS The NRG will conduct a writing session of up to five (5) days in length with PNNL ori the Preliminary Draft GEIS. This writing session will take place at PNNL's office in Washington, DC. The purpose of the writing session will be for the NRG to present its comments on the Preliminary Draft GEIS and to provide clarification of the comments, as needed. PNNL will make available staff involved in the preparation of the Preliminary Draft GEIS to take part in the writing session. The writing session agenda and schedule will be
- determined in consultation with the NRG COR in advance of the meeting. Subtask 4.6 -Camera-Ready and Publication-Ready Versions of Draft GEIS PNNL will incorporate comments from the Preliminary Draft GEIS writing session to produce the Camera-Ready Draft GEIS. During the NRC's concurrence review of the Camera-Ready Draft GEIS, it may be necessary for PNNL to make additional changes to the Draft GEIS. Following the resolution of comments received during the concurrence process, PNNL will submit to the NRG the publication-ready version of the Draft GEIS. Task 5 -Public Meetings and Comments on the Draft GEIS The NRG will issue the Draft GEIS for public comment in conjunction with a notice of availability that will be published in the Federal Register.
It is anticipated that the public comment period will conclude 60 calendar days after EPA's notice of availability of the Draft GEIS. in the Federal Register. (The NRG may extend the public comment period by two 15-day extensions, to a possible 90 calendar-day total based on requests from the public or other factors.)
The NRG will hoid up to four (4) public meetings during the Draft GEIS public comment pe.riod. Subtask 5. 1 -Draft GEIS Public Comment Meetings PNNL will be required to attend the Draft GEIS public comment meeting(s) for the project. In addition, PNNL may be requested by the NRG COR to provide information for review and provide comments on the PowerPoint presentation prepared by the NRG staff for the meeting(s);
and to assist the NRG staff in the preparation of anticipated questions and responses to those questions, as well as, other information for the meeting(s) (e.g., NRG presentation, posters, handouts).

14-D-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 *The NRG staff presently anticipates that up to two (2) Draft GEIS public comment meetings will be held on the same day or on consecutive days in the vicinity of the project site. The public meeting(s) will be attended by PNNL's TTL and up to five (5) PNNL technical staff members (subject matter experts).
PNNL's meeting attendees will be determined in consultation with the NRG COR in advance of the meeting(s).
PNNL will also provide logistical support for the Draft GEIS public comment meetings, including securing venues for the meetings, open-house venues and equipment, audio visual support for the meetings, as appropriate, and assisting NRG with coordinating other logistical aspects of the meetings both before and during the meetings.
NOTE: PNNL will assume labor hours and approximate costs of four (4) venues using standard audio/visual support. PNNL will propose modifications to this subtask should additional venues be needed, or should the cost of the venues exceed this estimate.
Before finalizing meeting logistics, PNNL must have COR approval.
Subtask 5.2 -Support and Facilitation for Draft GEIS Public Comment Meetings Under this subtask, PNNL will provide additional support and facilitation for the Draft GEIS public comment meetings, as needed. As directed by the NRG COR, PNNL will identify and communicate with local stakeholders or key national stakeholders in advance of the meetings to ensure that appropriate parties are included in information distribution, notified of m*eetings and project activities, and met with, if necessary.
PNNL will provide a skilled facilitator for the meetings to ensure that they are conducted in an orderly and productive manner. The facilitator, either a PNNL staff member or consultant, will have direct experience facilitating contentious NRG meetings on environmental and high-level waste storage and transportation topics. PNNL will assume support for and facilitation of four (4) total meetings, including preparation time, attending preparation meetings, attending and facilitating the public meetings, and providing post-meeting support. Subtask 5.3 -Management and Resolution of Public Comments on Draft GEIS PNNL will manage all public comments received during the public comment period. PNNL will delineate, compile, and bin (i.e., organize by topic area and related issue) all public comments on the Draft GEIS received by the NRG from all sources* (e.g. public comment meeting transcript(s), e-mail, regular mail, regulations.gov, etc.). Working closely with PNNL, the NRG COR will review and approve the delineation and binning of the comments.
PNNL will use the Comment Response Database, as appropriate, to delineate, bin, and respond to comments.
It is presently anticipated that approximately 1,000 unique comments will be received.
At the beginning of the public comment period, or prior to, the NRG and PNNL will develop binning guidance and bins for the comments.
Note that many of the comments may be submitted to the NRG near the end of the public comment period. Therefore, PNNL will begin comment delineation, compilation, and binning upon receipt of the first set of comments from the NRG COR and will proceed with delineation, compilation, and binning as each set of additional comments is sent by the NRG 8 NRC-HQ-25-14-D-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 COR. Note also that many commenters may submit multiple comments within a single submittal (e.g., emails, letters, or verbal or written public meeting statements containing several comments on a number of different topics), and PNNL will appropriately delineate, and bin the comments from such submittals.
Each document containing comments from external stakeholders will be identified with a unique identification number. PNNL will review all comments and delineate each unique, individual comment within each comment-document.
Each unique, individual comment will also have its unique identification number. As noted above, PNNL will start delineation of comments as soon as NRC provides the first comment-document (e.g.; e-mail, transcript, letter) and will provide the outcome of the delineation as it completes the review of documents (i.e., PNNL will not wait until it has finished reviewing and delineating all comments to submit the results of the delineation to the NRC COR). At the same time, PNNL will start binning the comments based on the scope and message of the comments.
The NRC COR (or team members) will review the binning and delineation in the CRD. If needed, PNNL will also run delineation reports. If the number of unique pieces of correspondence (comments) received on the Draft GEIS exceed 1,000, the NRC may, by the issuance of a modification to PNNL's task order, adjust PNNL's delivery time for the Appendix (Resolution of Comments on Draft GEIS). (See Optional Subtask 5.4). NOTE: Project setup and maintenance fees associated with the CRD will be funded by NRC Agreement No. NRC-HQ-41-13-0-0002, "Technical Assistance for the Development of Environmental Assessment Reactor Review Team Home (EARRTH) Tool for NMSS Environmental Reviews and Rulemaking Activities." (OPTIONAL)

Subtask 5.5 -Appendix for Comments Received on the Draft GEIS PNNL will also prepare written responses to the public comments on the Draft GEIS for those resource areas assigned to them. The NRC COR will work with PNNL to identify public comments that would require NRC preparation of the response given the regulatory or policy issues or implications raised by the commenter.
- PNNL will prepare an appendix containing the binned comments and the NRC's response to the like-grouped comments.
As the Appendix goes through NRC review and concurrence review, PNNL may be required to update the Appendix to resolve NRC comments.
The Appendix will be added to the Final GEIS as a new appe.ndix.
9 Task 6 -Prepare Final GEIS N RC-HQ-25-14-0-0001 NRC-HQ-50-17-T-0001 Attachment No. 1 After receipt of technical direction from the NRG COR, PNNL will continue with the development of the Final GEIS as indicated below. Subtask 6. 1 -Prepare Draft Final GEIS PNNL will prepare a Draft Final GEIS that includes revisions to the Draft GEIS made in response to public comments on the Draft GEIS evaluated under Subtask 5.5 and on any new or revised information that may become available following the development of the Draft GEIS. The changes to the Draft GEIS will be clearly shown as tracked changes with side bars in the Draft Final GEIS. lri addition, PNNL will incorporate the Final Compilation of Comments and Responses from Subtask 5.5 into the Draft Final GEIS as an appendix.
The comment responses will direct the reader to locations (section numbers, table numbers, figure numbers, etc.) within the Final GEIS where the text has been changed in response to the comments.
Subtask 6.2 -Writing Session for the Final GEIS A Final GEIS writing session of up to five (5) days in length will be held at PNNL's office in Washington, DC, or at another acceptable location.
The writing session will be held after PNNL receives NRC's comments on the Draft Final GEIS. PNNL will review, address, and incorporate the comments received on the Draft Final GEIS during the time period between the receipt of the comments and the Final GEIS writing session. At the meeting, staff from PNNL and NRG will conduct a line-by-line review of the Draft Final GEIS, as necessary, and produce revisions to the document.
PNNL's meeting attendees and the meeting agenda and schedule will be determined in consultation with the NRG COR in advance of the meeting. PNNL will make available staff involved in the preparation of the Draft Final GEIS to take part in the writing session, as needed. The writing session agenda and schedule will be determined in consultation with the NRG COR in advance of the meeting. Subtask 6.3 -Camera-Ready and Publication-Ready Versions of Final GEIS PNNL will incorporate comments from the Final GEIS writing session to produce the Camera-Ready copy of the Final GEIS. During the NRC's concurrence review of the Camera-Ready Final GEIS, it may be necessary for PNNL to make additional changes to the GEIS. Following the resolution of comments received during the concurrence process, PNNL will submit to the NRG the publication-ready version of the Final GEIS. (OPTIONAL)
Subtask 6.4 -Record of Decision Under this optional subtask, PNNL may be asked to assist the COR in preparing a Record of Decision and associated correspondence (letters, Federal Register notice, etc.). 10

These documents and materials may not be used or sold by PNNL without written authorization from the CO. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights. The definition of "unlimited rights" is contained in Federal Acquisition Regulation (FAR) 27.401, "Definitions." FAR clause at FAR 52.227-14, "Rights in Data-General," is hereby incorporated by reference and made a 'part of this contract/order.
