I The Commission directed the staff to extend the public comment period by 15 days to allow '

for a S0-day comment period. As noted in the Federal Reaister on August 13,1998, the 90-day comment period now extends from August 13,1998 to November 12,1998. This schedule should allow sufficient time for public review and comment.

The Nuclear Regulatory Commission has scheduled three public meetings to discuss the proposed rule and the proposed revision to the Medical Policy Statement. The three public meetings are scheduled for August 19-20, in San Francisco, Califomia; September 16-17, in I

Kansas City, Missouri; and October 21-22, in Rockville, Maryland. The last public workshop would be held approximately three weeks prior to the close of the comment period. In addition, the proposed rule and Medical Policy Statement will be posted on the Internet to provide interested parties with easy and timely access to these documents. Additional details on the l public meetings were published in the Federal Reaister on July 24,1998 (63 FR 39763).

'lhe American Colle of Nuclear Physicians (ACNP) and the Society of Nuclear Medicine

-(SNM) have begun reviewing the draft proposed rule to revise 10 CFR Patt '45, which was  ;

submitted to the Commission (SECY-98-128) on June 4,1998. Due to the size of this j rulemaking and the major impact that It will have on the practice of nuclear medicine, we request that you accept the NRC's Advisory Committee on the Medical Uses of Isotopes (ACMUI) recommendation and lengthen the proposed comment period by 45 days, j As proposed by the staff, the comment period would be 75 days. Assuming that the proposed rule is published in the Federal Register in mid-July, the comment penod would end in late  !

September.  :

• nic ACNP and SNM would like to provide meaningful comments to the NRC on the many  :

important issues raised by this proposed rule. To do so, however, we will need adequate time to review, analyze, distribute, collect, and collate information related to this rulemaking and secure the approval of two goveming bodies. We are concerned that a 75 day comment period will not allow sufficient time for this process, especially since most of the comment period would occur ,

during the summer, when personal vacation schedules often make it difficult for membership i organizations to reach decisions promptly.

In addition, the NRC has tentatively scheduled three public workshops on the propn<ni, the last of which is potentially within a week of the end of the comment period. ACNP and SNM would like the opportunity to hear discussions from stakeholder at these workshops and then portatially modify our comments based on this input.  ;

s For these reasons, we strongly urge you to extend the conunent period for an additional 45 days.

We do not believe that this extension would delay the publication of the final rule in June 1999, and a 1204y conunent period would provide sufficient time for all parties concemed to develop meaningful and constructive conunents to the Commission.
