Dear Chairman Jackson:

The American College of Nuclear Physicians (ACNP) and the Society of Nuclear Medicine (SNM) have begun reviewing the draft proposed rule to revise 10 CFR Part 35, which was submitted to the Commission (SECY-98-128) on June 4,1998. Due to the size of this rulemaking and the major impact that it will have on the practice of nuclear medicine, we request that you accept the NRC's Advisory Committee on the Medical Uses of Isotopes (ACMUI) recommendation and lengthen the proposed comment period by 45 days.

As proposed by the staff, the comment period would be 75 days. Assuming that the proposed rule is published in the Federal Register in mid-July, the comment period would end in late September.

The ACNP and SNM would like to provide meaningful comments to the NRC on the many important issues raised by this proposed rule. To do so, however, we will need adequate time to review, analyze, distribute, collect, and collate information related to this rulemaking and secure the approval of two governing bodies. We are concerned that a 75 day comment period will not allow sufficient time for this process, especially since most of the comment period would occur during the summer, when personal vacation schedules often make it difficult for membership organizations to reach decisions promptly.

In addition, the NRC has tentatively scheduled three public workshops on the proposal, the last of which is potentially within a week of the end of the comment period. ACNP and SNM would like the opportunity to hear discussions from stakeholder at these workshops and then l potentially modify our comments based on this input. l l
