In answering the 'ICA contentions, the Applicants continue to argue that KLD ETE is not a litigable issue. The TOA wishes to remind the Applicants of the Board order of April 29, 1986, address-ing flampton Contention III.
The Board saw fit to entertain con-tentions on KLD ETE when it officially became part of the NIIRERP.
Since the State of New Ilampshire intends to rely on KLD ETE as a tool for determining protective actions, and KLD ETE has been filed as part of the NiiRERP, the contentions must be heard at this time.
