In answering the 'ICA contentions, the Applicants continue to argue that KLD ETE is not a litigable issue. The TOA wishes to remind the Applicants of the Board order of April 29, 1986, address-ing flampton Contention III. The Board saw fit to entertain con-tentions on KLD ETE when it officially became part of the NIIRERP.

Since the State of New Ilampshire intends to rely on KLD ETE as a tool for determining protective actions, and KLD ETE has been filed as part of the NiiRERP, the contentions must be heard at this time.

The Applicants refer to the Commission's " realism" decision as the rationale for dismissing TOA contentions No. 7 & 8. The TOA stands by its contention that KLD ETE indeed violates 10 CFR 50,47(b) (1) and (b) (10) . In additon, KLD ETE has yet to be assessed by exercise in compliance with 10 CPR PART 50, App. E, IV, F, Training:

Exercises shall test the adequacy of timing and _

content of implementing procedures and methods (emphasis added),

Furthermore, footnote 4 of section IV clearly addresses the need of an exercise to test:

". . .the major observable portions of the on-site and off-site emergency plans and mobilization of State, local and licensee personnel and other resources in sufficient. numbers to verify the capability to respond to the accident scenario' (emphasis added)."

The requirements are broader than the issue discussed in the Shoreham decision. Tha Applicants could have attempted to demonstrate the ability to implement responses through use of a Massachusetts 4 Compensatory Plan (". . .other resources. . .") . For reasons unknown to the 'ICA, the Applicants chose not to file or exercise that capability.

Their failure to compensate reinforces the 'IDA position that the 4

requirements of 10 CFR 50.47(b) (1) and (b) (10) have not been fulfilled.

If the Applicants intend to employ one ETE while the State cf New llampshire uses another during an accident scenario, the exercise of 2-26-86 did not provide any reasonable assurance that the provisions I of 10 CFR 50.47 (b) (1) and (b) (10) can, or would be met.

Since neither the Applicants nor the State of New flampshire (which ultimately has the responsibility of implementing its RERP) have not provided the assurances necessary that adequate protective ,

measures can and will be taken, the 'It?A's eight contentions abould be admitted.
