Attached is the safety evaluation report prepared by the Office of Nuclear Reactor Regulation (NRR), in which the staff accepts the Topical Report '

BAW-10186P of Framatome Cogema Fuels (FCF) for referencing in license applications. The staff proposes that the Committee to Review Generic Requirements (CRGR) review be waived in accordance with the procedures in the ,

memorandum referenced above.

BAW-10186P describes an improved high burnup methodology. The improved methodology is very similar to the currently approved FCF methodology. The subject report does not present any new methodology nor does it require any new staff technical position; it merely presents another application of an existing and approved methodology.

According to the CRGR charter, CRGR should review all of the staff's approvals of topical reports. However, we believe that CRGR review is not necessary because the staff approval of the FCF Topical Report BAW-10186P does not represent a new position by the staff. If you agree that a CRGR review is not necessary, please so indicate by signing below. Otherwise, we will prepare an appropriate CRGR package.
