Comments on Draft Regulatory Guide DG-5022, Cyber Security Programs for Nuclear Facilities The purpose of this letter is to provide Duke comments on the draft Regulatory Guide DG-5022 dated May 2008 as transmitted in a memorandum dated June 2, 2008 from Scott A. Morris, Deputy Director, Division of Security Policy, Office of Nuclear Security and Incident Response, U.S. Nuclear Regulatory Commission.

Duke appreciates the opportunity to provide comments and submits an Attachment to this letter for consideration by the NRC staff.

Duke representatives attended the stakeholder meeting on July 18, 2008 which provided the opportunity to answer several comments that we had on DG-5022.

Duke has also begun its review of SECY 2008-99 dated July 9, 2008 and made publicly available last week. This SECY contains additional information that would assist in preparing the final regulatory guidance document.

Duke recommends that the staff continue its dialogue with stakeholders on this regulatory guide as it continues to be developed. Duke will support efforts by NEI to further improve the regulatory guidance on cyber security.
