Dear Sir or Madam:

By letter dated May 29,2013, Entergy Operations, Inc., the licensee, submitted Revision 16 to the Indian Point Energy Center "Physical Security, Training and Qualification, Safeguards Contingency Plan, and Independent Spent Fuel Storage Installation Security Program." The Nuclear Regulatory Commission (NRC) staff is currently reviewing the changes to ensure that the licensee has complied with applicable regulatory requirements of Title 10 of the Code of Federal Regulations (10 CFR) 73, "Physical Protection of Plants and Material," and the provisions of 10 CFR 50.54(p)(2), which allows licensees to make changes without prior NRC approval.

The NRC staff is reviewing the submittal and has determined that additional information is needed to complete its review. The specific questions are found in the enclosed request for additional information (RAI). Based on our discussions we understand that a response to the RAI will be provided within 30 days of the date of this letter.

REQUEST FOR ADDITIONAL INFORMATION OFFICE OF NUCLEAR SECURITY AND INCIDENT RESPONSE 10 CFR SO.S4(p)(2) CHANGES TO SECURITY PLAN ENTERGY NUCLEAR OPERATIONS, INC INDIAN POINT NUCLEAR GENERATING UNIT NOS. 1,2, AND 3 DOCKET NOS: SO-03, SO-247, and SO-286 By letter dated May 29, 2013 (Agencywide Documents Access and Management System Accession No. ML 131S6A006), Entergy Nuclear Operations, Inc. submitted the Indian Point Energy Center Physical Security Plan (PSP), Training and Qualification Plan (T&QP), and Safeguards Contingency Plan, Revision 16. The enclosure to the letter contained Safeguards Information and has been withheld from public disclosure. The U.S. Nuclear Regulatory Commission (NRC) staff is currently reviewing the submittal to ensure compliance with Title 10 of the Code of Federal Regulations (10 CFR), Section SO.S4(p)(2). The NRC staff has determined that the additional information requested below is needed to complete its review.

1. The description of changes report and Section 2.4 "Medical Examinations and Physical Fitness Qualifications," of the T&QP (Appendix B), discuss changes to the physical fitness test for strength, endurance, and agility. Describe how these changes continue to simulate, as closely as practicable, the specific conditions under which the individual shall be required to perform assigned duties and responsibilities. Additionally, describe what is worn by security force members during each aspect of this physical fitness test.

Lastly, confirm that appropriate changes will be made during the next revision of the site's security plans to clearly describe the physical fitness test.

Regulatory Basis:

Consistent with 10 CFR 73.SS(c)(1 )(i), "licensee security plans must describe how the licensee will implement requirements of this section through the establishment and maintenance of a security organization, the use of security equipment and technology, the training and qualification of security personnel, the implementation of predetermined response plans and strategies, and the protection of digital computer and communication systems and networks."

Consistent with 10 CFR 73.SS(c)(4), "the licensee shall establish, maintain, implement, and follow a Training and Qualification Plan that describes how the criteria set forth in Appendix B to this part, 'General Criteria for Security Personnel' will be implemented."

Consistent with 10 CFR Part 73, Appendix B, VI. (A.)(S), "the licensee shall ensure that the training and qualification program simulates, as closely as practicable, the specific conditions under which the individual shall be required to perform assigned duties and responsibilities."

- 2 Consistent with 10 CFR Part 73, Appendix B, VI. (B.)(4)(b)(3), "the physical fitness test must include physical attributes and performance objectives which demonstrate the strength, endurance, and agility, consistent with assigned duties in the Commission-approved security plans, licensee protective strategy, and implementing procedures during normal and emergency conditions."

2. The description of changes report and Section 9 "Security Personnel Equipment" of the PSP include a change to the personnel equipment list and associated annual requalification training on that equipment. The description of changes did not adequately describe the rationale for this change. Further describe the rationale for this change in issued equipment and associated annual requalification training, to include any supporting site-specific analyses. Describe whether or not it applies to all members of the security organization or particular positions within the security organization.

Additionally, describe impacts, if any, to the site's use of force continuum.

Regulatory Basis:

Consistent with 10 CFR 73.55( c)(1 )(i), "licensee security plans must describe how the licensee will implement requirements of this section through the establishment and maintenance of a security organization, the use of security equipment and technology, the training and qualification of security personnel, the implementation of predetermined response plans and strategies, and the protection of digital computer and communication systems and networks."

Consistent with 10 CFR 73.55(c)(4), "the licensee shall establish, maintain, and implement, and follow a Training and Qualification Plan that describes how the criteria set forth in Appendix B to this part, 'General Criteria for Security Personnel.' will be implemented."

Consistent with 10 CFR Part 73, Appendix B, VI. (D.)(2.)(a), "armed and unarmed individuals shall be requalified at least annually in accordance with the requirements of this appendix and the Commission-approved training and qualification plan."

Consistent with 10 CFR Part 73, Appendix B, VI. (G.)(2.)(c)(3), "based on the licensee protective strategy and the specific duties and responsibilities assigned to each individual, the licensee should provide, as appropriate. but is not limited to, the following: (1) Flashlights and batteries; (2) Baton or other non-lethal weapons; (3) Handcuffs; (4) Binoculars; (5) Night vision aids (e.g. goggles, weapons sights); (6) Hand-fired illumination flares or equivalent; (7) Duress alarms."
