NOTICE OF VIOLATION The Cleveland Electric Illuminating                            Docket No. 50-440

As a: result of the inspection conducted on November 3 through December 21, 1987, and in.accordance with 10 CFR Part 2, Appendix C - General Statement of Policy l:                                                    and Procedure for NRC Enforcement Actions (1987), the following violation was identified:
10 CFR 50, Section 50.59 states:    "The holder of a license authorizing operation of a production or utilization facility may make changes to that facility as described in the safety analysis report without prior Commission approval unless the change involves an unreviewed safety question or change to the technical specifications." Further, the licensee must maintain records including a written safety evaluation which provides the bases.for the determination that the change does not involve an unreviewed safety question.
Contrary to the above, the licensee failed to perform the required safety
,                                                    evaluation for temporary modification LLJED No. 1-87-077 which changed-the i
circuitry of the Division III Diesel Generator water jacket heater as described in Section 9.5.9.2.2 of the FSAR by adding filter chokes to each electrical phase of these heaters.
This is a Severity Level IV violation-(Supplement 1).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this
                                            . office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:      (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good'cause shown.
