Dear Mr. DeLaBarre:

Enclosed is an application (XMAT415/04), dated November 22, 2020, received by the U.S.

Nuclear Regulatory Commission (NRC), from Linde Electronics and Specialty Gases, a Division of Linde Gas North America LLC., requesting Amendment No. 04 to its existing license XMAT415. The license presently authorizes the export of a cumulative total of 23,350 kilograms (kg) of deuterium gas to the Republic of Korea for the non-nuclear end use of fiber cable manufacturing.

The purpose of the amendment is to 1) add an additional Ultimate Foreign Consignee and

2) increase the amount of deuterium from 23,350 kg to 24,186 kgs.

In accordance with our mutual understanding, documented in August 2016, Processing applications for licenses for exports of deuterium, we would appreciate receiving your judgement as to whether:

The facts of the proposed export are consistent with non-nuclear end use; The Executive Branch does not see a need for assurances from the recipient government; and The proposed export would not be inimical to the common defense and security of the United States.
