(" August 12 Order"), the Licensing Board rejected Joint Interve-nors' proposed Contention EP-2(d), which would have required Applicants to " ensure that all residents have televisions or ra-dios to turn to for additional information in the event of a ra-diological accident."

While the Board agreed with Applicants l

that NUREG-0654 does not require Applicants to ensura,that all residents hase radios or TVs, the Board noted that,NJREG-0654 "unequivecally requires that Applicants demonstrate that the EDS is in place."

August 26, 1986 Page 2 Specifically, the Board expressed concern about language in Appendix 3 of Revision 1 of the "Vogtle Electric Generating Plant Unit 1 and Unit 2 Emergency Plan" ("Vogtle Plan") which indi-cated:

Detailed information and instructions may be broadcast en local commercial radio and television stations; and Within the plume exposure pathway EPZ the system will provide an alerting signal and notification by NOAA radio; further notifi-cation might also be provided by local com-mercial radio and television stations which may be, activated via EBS.

(Emphasis supplied by the Board).

Although the Board acknowledged that the Vogtle Plan includ-ed letters of agreement from local radio and TV stations, the Board characterized the language of the plan itself as "equivo-cal."

The Board therefore directed Applicants to " change the language in Appendix 3 to the Vogtle Plan to conform to the clear intent of Appendix 3 to NUREG-0654," and to " inform the Board when the appropriate change of language has been made and distri-buted to holders of copies of the Vogtle Plan."

By letter dated February 25, 1986, Applicants transmitted to the NRC revision 5 of the Vogtle Plan.

(Copies were also pro-vided to Joint Intervenors and other holders of controlled copies of.the Vogtle Plan).

Appendix 3 of revision 5 eliminates the equivocal language quoted by the Board, and affirmatively states:

Detailed information and instructions will be broadcast on local EBS radio and tele-vision stations.

Twenty commercial radio stations (13 AM; 7 FM), three commercial television stations; and one educational television station whose broadcasts are received in the plume exposure pathway EPZ have agreed to broadcast emergency Instructions and information in cooperation i

Each of these commercial stations is a member of the Einergency Broadcasting System.
