1996 AGREEMENT STATES MEETING ACTION ITEMS f

1. 111m: NRC staff would explore the possibility of holding an additional ,

meeting on Strategic Assessment at a West Coast location.

M. Knapp, NMSS s Action Taken: OSP discussed the West Coast meeting location with Steering l Committee. .The schedule did not permit adding an additional l' meeting.

2. 11gs: NRC will consider funding travel expenses of an OAS  !

Executive Committee designee if an Executive Committee  !

member cannot attend one of the Strategic Assessment public I meetings.

Action Taken: NRC was willing to fund travel of a designee. However, ,

misunderstanding about the travel funding need of the designated individual resulted in no prior NRC approval for the -

travel. The designated individual agreed to fund his own I travel, at the request of NRC. i i

3. 'lism: NRC should send out course results for students who did not  :

successfully complete a course. i Assioned To: OSP, D. Sollenberger Action Taken: The policy on successfully completing or failing to successfully complete NRC training courses was drafted and reviewed by the NRC/OAS Working Group on Training. An All Agreement States letter (SP-96-118) was sent November 20,1996.

Status: OPEN Next Action: The course results for students not successfully completing courses will be sent out.

Due Date: April 10,1997

4. J. tam: NRC should consider providing States copies of NRC course  !

manuals.

Action Taken: The Technical Training Division (TTD) and OSP will develop a list that will be sent to the Agreement States stating which  !

course manuals are available and a questionnaire so that the  !

States will be able to request copies of training manuals for courses that the TTD has developed or had developed by contractors. Manuals for commercially available courses listed in the TTD catalog will have to be obtained from the vendor.

Once the questionnaires have been returned, TTD will start reproduction and shipping of the manuals. It may require  !

several months to reproduce and ship the manuals depending  !

on the number required.

Status: OPEN Next Action: TTD prepared an information request to be sent to the  !

Agreement States that will be reviewed by OSP and sent to the States. .

5. Llam: NRC should consider incorporating Agreement State comments into the Low-Level Waste and Uranium Recovery guidance documents for upcoming Integrated Materials Performance i Evaluation Program (IMPEP) reviews. l l

Assioned To: OSP, K. Schneider Action Taken: The guidance on Low Level Waste will be revised to incorporate Agreement State comments. The Uranium  :

Recovery guidance was sent October 7,1996, for comment and comments are being analyzed. ]

6. 11am: NRC should consider using collaborative State /NRC process to develop future IMPEP guidance.

Assioned To: OSP, K. Schneider Action Taken: When possible, NRC will use a collaboration process for development of IMPEP guidance. NRC will always provide opportunity for Agreement States review and comment on proposed or draft guidance.

7. J. tarn: NRC should establish a schedule to inform States of its position on sites in Agreement States formerly licensed by AEC/NRC.

Assioned To: OSP, P. Lohaus Action Taken: Staff has drafted a letter to States and a Commission paper for Commission review and approval prior to dispatch of the letter.

Status: OPEN Next Action: Provide staff paper to Commission for approval.

Due Date: Notify Commission by April 15,1997, and States by May 30, 1997,

8. Itam: NRC should provide copies of the draft guidance developed by the Federal Radiological Preparedness Coordination Committee (FRPCC) to the Agreement States.

Assioned To: AEOD, F. Congel Action Taken: The AEOD staff will send the RAD ,4nnex, and any other appropriate documents, to the State rad health and emergency management organizations prior to publication in the Federal Reaister. This was done with FRERP with good results. For guidance not published in the Endgral Reatster. FEMA's Strategic Review Steering Committee (SRSC) is studying how to obtain customer comments in the future. FEMA is putting SRSC meeting highlights on its Home Page for States to see status of discussions and provide comments.

9. Itam: NRC should review its procedure for release of Preliminary Notifications (PNs) to the public and on internet and distribution to the Agreement States.

Assioned To: NRR, A. Chaffee Action Taken: Staff has reviewed the guidance on Preliminary Notifications (PNs) as contained in the NRC Inspection Manual (Manual Chapter 1120) and concluded _that no changes are needed. All PNs have a boilerplate statement, "This preliminary notification constitutes EARLY notice of events of POSSIBLE safety or public interest significance. The information is as initially received without verification or evaluation, and is basically all that is known by the Region staff on this date." Supplemental

, PNs are issued when it is necessary to add or correct information. No change is necessary in guidance for release of PNs to the public and on loternet and distribution to the Agreement States.

10. Llttrn: NRC should provide Agreement States information from file reviews on locations in Agreement States which may have old RAMCO irradiators or other radioactive materials provided by the AEC to schools under the Atoms for Peace Program.

Assioned To: Region I, A. Randolph Blough Action Taken: Region I drafted an All Agreement and Non-Agreement States letter SP-97-016, that was sent March 10,1997, to provide information to all States.

11. ligm: NRC should develop a list of previous Division 3 items of compatibility that would be more restrictive under the new compatibility policy.

Assioned To: Adequacy / Compatibility Working Group, C. Maupin, OSP, and A. Codwin, AZ Action Taken: The list will be compiled by the NRC/ Agreement State Compatibility Working Group as a part of the analysis and response to comments.

Sollenberger Action Taken: OSP staff assembled the relevant data from the Controller for the last 3 years (1995,1996, and 1997) for the Office of State Programs and the Office for Analysis and Evaluation of Operational Data (AEOD). This data is compiled in NUREG-1100, Vol.12 and SECY 95-017 and enclosed in an Agreement State letter dated December 5,1996, SP-96-120.

Both OAS and NRC staff believe only a single meeting should be held in the fall time frame this year, currently scheduled for October 16-18,1997, at the Akport Westin Hotel, Los Angeles. An GAS letter providing further information on this decision and plans for the fall meeting will be prepared and issued.
