DISCUSSION Inits"Memorandum andOrderonDiscovery Motions(II)"theBoardsuspended alldiscovery obligations withrespecttosafetyandcombinedsafety/environ-mentalcontentions untilafterthehearingofenvironmental issuesis completed.

-TheBoardcitedamongitsreasonsfortakingthatactionthefactthatsuchapostponement wouldnotadversely affecttheabilityofanypartytoprepareforhearingorpreventthecoranencement ofthehearingonatimelybasis./Anotherofitspurposeswastoreducewhatitviewed3/tobethethenheavydemandsofthediscovery processonIntervenors.-

AstheApplicants pointout,changedcircumstances supportreconsideration oftheBoard'sdecisiontosuspenddiscovery onsafetycontentions untilthehearingofenvironmental issuesiscompleted.

AtthetimetheBoardmadeitsdecisiontosuspenddiscovery onsafetyissuesitappeared, basedonthetimeperiodbetweenissuanceoftheFinalEnvironmental Statement (FES)andtheSafetyEvaluation Report(SER)andSERSupplement, thatthehearingonsafetyissuescouldnotbeginuntilalmostayearafterthehearingonenvironmental issueshadbegun.~4/Basedonmorerecentestimates ofthescheduleforissuingtheFESandtheSERitnowappearsthatwaitinguntilaftercompletion ofthehearingonenvironmental issuestoreinstate discovery obligations onsafetyissuescouldresultinunnecessary delaysinboththestartofthehearingonsafetyissuesandcompletion 1/LBP-79-31, 10NRC597,605.(October 30,1979).2/Id.g3Id.4/Id. oftheentireproceeding.

-Thecurrently predicted timespanbetween5/issuanceoftheFESandtheSERisonemonth.TheFESandtheSERarescheduled tobeissuedonJanuary1andFebruary1,1981respectively.-

6/Itwouldappearprudenttoreinstate discovery obligations onsafetyissuesnowwhilethetimedemandsofthisproceeding onpartiesarerelatively light.Aftercompletion ofthehearingonenvironmental issues,thedutytoprepareproposedfindingsandconclusions onenvironmental issuesandtheobligation tocompletediscovery andprepareforthehearingonsafetyissueswouldimposeconflicting timedemandsonallpartiestotheproceeding.
