SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) invites public c omment

on the renewal of Office of Managem ent and Budget (OMB) approva l for an existing

collection of information. The information collection is entit led, Reporting of Defects and

Noncompliance.

considered if it is practical to do so, but the Commission is a ble to ensure consideration

In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35),

the NRC is requesting public comment on its intention to reques t the OMBs approval for

the information collection summarized below.

1. The title of the information collection : 10 CFR Part 21, Reporting of Defects

and Noncompliance.

2. OMB approval number: 3150-0035.

3. Type of submission: Extension.

4. The form number, if applicable : Not applicable.

5. How often the collection is required or requested : On occasion. Defects and

noncompliances are reportable as they occur.

6. Who will be required or asked to respond: Individual directors and

responsible officers of firms constructing, owning, operating, or supplying the basic

components of any facility or activity licensed under the Atomi c Energy Act of 1954, as

amended, or the Energy Reorganization Act of 1974, as amended, to report immediately

to the NRC the discovery of defects in basic components or fail ures to comply that could

create a substantial safety hazard.

7. The estimated number of annual responses: 755 responses (43 reporting

responses + 357 third party disclosure response + 355 recordkee pers).

9. The estimated number of hours needed annually to comply with the

information collection requirement or request: 28,975 (3,407 reporting hours + 25,200

10. Abstract: Part 21 of title 10 of the Code of Federal Regulations (10 CF R),

requires each individual, corporation, partnership, commercial grade dedicating entity, or

other entity subject to the regulations in this part to adopt a ppropriate procedures to

evaluate deviations and failures to comply to determine whether a defect exists that

could result in a substantial safety hazard. Depending upon th e outcome of the

evaluation, a report of the defect must be submitted to the NRC. Reports submitted

under 10 CFR part 21 are reviewed by the NRC staff to determine whether the reported

defects or failures to comply in basic components at the NRC li censed facilities or

activities are potentially generic safety problems. These repo rts have been the basis for

the issuance of numerous NRC Generic Communications that have contributed to the

improved safety of the nuclear i ndustry. The records required to be maintained in

accordance with 10 CFR part 21 are subject to inspection by the NRC to determine

compliance with the subject regulation.

III. Specific Requests for Comments

The NRC is seeking comments that address the following questio ns:

1. Is the proposed collection of information necessary for the NRC to properly

perform its functions? Does the information have practical uti lity? Please explain your

answer.

2. Is the estimate of the burden of the information collection accurate? Please

explain your answer.

3. Is there a way to enhance the quality, utility, and clarity of the information to

be collected?

4. How can the burden of the information collection on responde nts be

minimized, including the use of automated collection techniques or other forms of

information technology?

5. Are the current burden estimates for recordkeeping accurate given that

records must be retained for longer than three years (for examp le, entities providing a

certified design or design approval under Part 52 retain any no tifications sent to

purchasers and affected licensees for a minimum of 5 years afte r the date of the

notification, and retain a record of the purchasers for 15 year s after delivery of the

design)? Please explain your answer.
