TENNESSEE PROPOSED LEGALLY BINDING REQUIREMENTS (LICENSE CONDITION FOR DECAY IN STORAGE)

Dear Matthew Greenwood:

We have reviewed Tennessees request concerning their Decay-in-Storage regulation, received by our office on March 6, 2024. Tennessee informed the NRC that they are currently reviewing a request from a licensee seeking exemption from this regulation. Tennessee presented their rationale, citing the small difference in half-life for Tm-170 (128.6 days) and its low activity, asserting that the exemption would not pose undue harm or risk to the environment or public.

Tennessee is asking NRC to determine the acceptability of this exemption. We discussed our review of the license condition with you on May 7, 2024.

The Standing Committee on Compatibility (Committee) reviewed the Tennessee proposed license condition. The Committees review was conducted in accordance with the "Agreement State Program Policy Statement" (82 FR 48535); October 18, 2017, and the categorization process for NRC program elements in NRC Management Directive 5.9 "Adequacy and Compatibility of Program Elements for Agreement State Programs." The Committee determined that Tennessee may approve the request as an exemption to their regulation considering it is a request from a single licensee.
