We have reviewed the final revisions to the Utah Administrative Code R313-19-13, Exemptions, R313-21-21, General Licenses -Source Material, and R313-22-55, Conditions of Specific Licenses to Initially Transfer Source Material for Use Under Section R313-21-21, received by our office on February 8, 2024, to incorporate changes requested by the U.S. Nuclear Regulatory Commission (NRC). These regulations were reviewed by comparison to the equivalent NRC rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2013-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on April 5, 2024.
We have reviewed the final revisions to the Utah Administrative Code R313-19-13, Exemptions, R313-21-21, General Licenses -Source Material, and R313-22-55, Conditions of Specific Licenses to Initially Transfer Source Material for Use Under Section R313-21-21, received by our office on February 8, 2024, to incorporate changes requested by the U.S. Nuclear Regulatory Commission (NRC). UTAH FINAL REVISIONS TO THE ADMINISTRATIVE CODE R313-19-13, R313-21-21, R313-22-55, AND R313-21-21

Dear Douglas Hansen:

We have reviewed the final revisions to the Utah Administrative Code R313-19-13, Exemptions, R313-21-21, General Licenses -Source Material, and R313-22-55, Conditions of Specific Licenses to Initially Transfer Source Material for Use Under Section R313-21-21, received by our office on February 8, 2024, to incorporate changes requested by the U.S. Nuclear Regulatory Commission (NRC). These regulations were reviewed by comparison to the equivalent NRC rules and the requirements of Regulation Amendment Tracking System Identification Number (RATS ID) 2013-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on April 5, 2024.

As a result of our review, we have one editorial comment. Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that the regulations, as adopted, meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

The SRS Data Sheet summarizes our knowledge of the status of other Utah regulations, as indicated.
