Office of Nuclear Reactor Regulation Items of Interest Week Ending November 17, 2023 Carbon Free Power Project (CFPP) and NuScale Power Submit a Request to NRC to Withdraw the Limited Work Authorization Application, Topical Reports, and Exemption Request Associated with the CFPP Combined License Application On November 10, 2023, Carbon Free Power Project (CFPP) and NuScale Power jointly submitted a request to the U.S. Nuclear Regulatory Commission (NRC) to withdraw the Limited Work Authorization Application, Topical Reports, and Exemption Request associated with the CFPP Combined License Application (COLA), following the November 8, 2023, announcement by Utah Associated Municipal Power System and NuScale Power on the termination of the CFPP (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23317A110). Accordingly, the NRC staff is in the process of closing out the Cost Activity Codes and Enterprise Project Identification Codes related to these CFPP project tasks.
Separately, NuScale Power informed the staff of its plan to request NRC staff to complete the CFPP COLA Readiness Assessment.
NRC Staff Presented to the West Virginia Legislature Joint Standing Committee on Energy and Manufacturing On November 14, 2023, staff from Region II, Office of Nuclear Reactor Regulation, and Office of Nuclear Material Safety and Safeguards presented to the West Virginia Legislature Joint Standing Committee on Energy and Manufacturing at their interim meetings held in Wheeling, WV. The staffs presentations provided an overview of reactor licensing processes, preparations for advanced reactor licensing, oversight of fusion systems, and the reactor oversight process.
The briefing was provided at the Committees request as it considers nuclear power options for West Virginia.
NRC Hosts Public Meeting to Discuss Reactor Oversight Process Topics with the Nuclear Industry and the Public On November 16, 2023, the NRC staff hosted a routine public meeting related to the Reactor Oversight Process (ROP) to discuss planning for a public workshop to explore developing corporate level inspections (ML23305A166); NRC staffs initial review of draft NEI 99-02 Revision 8; inspection and assessment of Probabilistic Risk Assessment Configuration Control (ML23315A000) and the corresponding draft Operating Experience Smart Sample (ML23312A335); a recent revision to Inspection Procedure 71152, Problem Identification and Resolution (ML23313A148); an overview of the recent rulemaking related to Price-Anderson Act Provisions (ML23319A341); and an upcoming revision to Inspection Manual Chapter 0309, Reactive Inspection Decision Basis for Reactors. Industry representatives presented for NRC consideration a draft Frequently Asked Questions document for Turkey Point Unplanned Scrams Performance Indicator (ML23318A178). Attendees included representatives from Nuclear Energy Institute, NextEra Energy, Constellation, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for January 17, 2024.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending November 17, 2023 Emergency Preparedness for Small Modular Reactors and Other New Technologies:
Final Rule and Guidance; 10 CFR Parts 50, 52, and 72 [NRC-2015-0225; RIN 3150-AJ68]
On November 16, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a final rule in the Federal Register (88 FR 80050) amending its regulations to include new alternative emergency preparedness requirements for small modular reactors and other new technologies.
The final rule acknowledges technological advancements and other differences from large light-water reactors that are inherent in small modular reactors and other new technologies. The NRC is concurrently issuing Regulatory Guide 1.242, Performance-Based Emergency Preparedness for Small Modular Reactors, Non-Light-Water Reactors, and Non-Power Production or Utilization Facilities. The final rule is effective December 18, 2023.
