Onbehalf  oftheU.S. Nuclear Regulatory    Commission    (NRC),    Iam responding    toyour June11,2021, letterinwhich  youexpress  interest in  pursuing anagreement      between    theNRC andthe StateofIndiana pursuant toSection    274b of theAtomicEnergy        Actof1954,    as amended. Weappreciate  your earlycommunication on thismatter.TheNRCstaff              isavailable toprovideguidance tothe  StateofIndiana  inthe  development    oftheAgreement      State application.
Asrequired bythe  Act,theNRCstaff    will review  theapplication andconduct      an assessment ofthe compatibility oftheIndiana    program  with theNRC's program andthe adequacy ofIndiana'sprogram  toprotect public  health  andsafetywith respect tothe      materials coveredbytheproposed  agreement. After  its review,  theNRCstaffwill provide the      resultsof itsassessmenttotheCommission. lftheCommission        approves  theproposed agreement, the NRCwill publishthetextanda summary    ofits  assessment    intheFederalRegister for    public comment. TheActrequires  thattheproposed    agreement    bepublished    onceeach week for    4 consecutive weeks. After          ofthecomment expiration                  period, theCommission    will consider  any comments received andmakea final  decision    onthe  request. Youwill  benotifiedpromptly of andtheNRCstaff thedecision,                will coordinate    with Indiana  stafftoestablish  aneffective date fortheagreement, andIndiana  would assume    regulatory  authority  overthe acquisition, possession,use,transfer,anddisposal  ofthematerials    identified  intheagreement.
TheCommission  welcomes  theState's    interest inbecoming    anAgreement    State  and looksforwardtothecontinued  collegial relationship  that  theNRCandtheState        ofIndiana  have enjoyed inthepast.
