Iamresponding toyour June11,2021,letter inwhichyouexpress interest inpursuing anagreement between theNRC andtheState ofIndiana pursuant toSection 274b of theAtomicEnergy Actof1954,as amended.
Weappreciate yourearly communication on thismatter.TheNRCstaff isavailable toprovide guidance totheState ofIndiana inthe development oftheAgreement State application.
Asrequired bytheAct,theNRCstaff will review theapplication andconduct an assessment ofthecompatibility oftheIndiana program with theNRC's program andthe adequacy ofIndiana's program toprotect public health andsafetywith respect tothematerials covered bytheproposed agreement.
After itsreview, theNRCstaffwill provide theresults of its assessment totheCommission.
lftheCommission approves theproposed agreement, the NRCwill publish thetextandasummaryofits assessment intheFederalRegister forpublic comment.TheActrequires that theproposed agreement bepublished onceeach weekfor4 consecutive weeks.After expiration ofthecommentperiod, theCommission will consider any comments received andmakeafinal decision ontherequest.
Youwill benotifiedpromptly of thedecision, andtheNRCstaff will coordinate withIndiana staff toestablish aneffective date fortheagreement, andIndiana wouldassumeregulatory authority overtheacquisition, possession, use,transfer, anddisposal ofthematerials identified intheagreement.
TheCommission welcomes theState's interest inbecoming anAgreement State and looks forward tothecontinued collegial relationship that theNRCandtheState ofIndiana have enjoyed inthepast.
