PROPOSED REVISIONS TO 10 CFR 170 AND 171 ON LICENSE AND ANNUAL FEES Gentlemen:

On June 27, 1988, the U.S. Nuclear Regulatory Comission published in the Federal Register (53 FR 24077) for public comment the enclosed Notice of Proposed Rulemaking. This notice proposes revisions to the fee requirements of 10 CFR 170 ("Fees for Facilities and Materials Licenses and Other Regulatory Services...") and 171 ("Annual Fee for Power Reactor Operating Licenses"). These revisions are being made to update the current fees and to implement Section 5601 of the Omnibus Budget Reconciliation Act of 1987 (Public Law 100-203) eno aed by the Congress. The fee legislation requires the Comission to collect under 10 CFR 170 and 171, as well as under other provisions of law, not less than 45 percent of its costs for each of fiscal years 1988 and 1989.

Coments should be submitted by July 27, 1988. The NRC staff will hold a public meeting to discuss the proposed changes and to answer any questions on July 7, 1988, at 3:00 p.m. in Room 2F-17 at the NRC's White Flint North Building,11555 Rockville Pike, Rockville, Maryland.

The major changes proposed to Parts 170 and 171 would:

1. Part 170:
a. Remove the fee ceilings for reactor and major fuel cycle permits, licenses, amendments and inspections,
b. Revise the hourly rate in 10 CFR 170.20 for NRC professional staff time spent providing various regulatory services and provide for an annual adjustment.  :
c. Charge for all routine and non-routine inspections; the current maximum billing frequency is being eliminated.

d. Remove the application fee for reactor facility license amendments and other approvals, as well as for reactor related reports.
