The transfer also covers the licenses for the permanently shut down Indian Point Unit 1 and the independent spent fuel storage installation at Big Rock Point. The staff's approval of the transfer is effective July 28.
Entergy Nuclear Operations submitted an application on July 30, 2007 (supplemented by letters dated Oct. 31 and Dec. 5, 2007, and Jan. 24, March 17, April 22 and May 2, 2008),
requesting approval of the license transfers. An Entergy Corp. restructuring will create a new independent corporation, Enexus Energy, which will own the individual licenses via holding companies. Entergy and Enexus will jointly own the company operating the facilities, Entergy Nuclear Operations, which will become EquaGen Nuclear LLC.
Matters considered by the NRC included financial and technical qualifications, as well as maintenance of accumulated decommissioning funds. Entergy also needs additional federal and state approvals before the company can complete the proposed transaction.
On Jan. 16, 2008, the NRC published notices in the Federal Register (one for each affected plant) stating the agency was considering the transfer application, and offering an opportunity to request a hearing and provide public comments. The NRC received public comments and two requests for hearings. The requests for hearings are currently pending before the Commission, and the comments were addressed in the staffs review.
A copy of the NRCs approval orders and accompanying non-proprietary safety evaluation report will be placed in the NRCs Public Document Room, One White Flint North, 11555 Rockville Pike, Room O-1 F23, Rockville, MD 20852 (telephone 1-800-397-4209 or 301-415-4737). The non-proprietary safety evaluation will also be available on the NRC=s Agency-wide Documents Access and Management System (ADAMS), by entering ML081080352 at this address: http://adamswebsearch.nrc.gov/dologin.htm. Help in using ADAMS is available by calling the Public Document Room.
