UNITED STATES OF AMERICA RAS 11806 NUCLEAR REGULATORY COMMISSION DOCKETED 06/20/06 ATOMIC SAFETY AND LICENSING BOARD SERVED 06/20/06 Before Administrative Judges:

Alex S. Karlin, Chairman Dr. Richard E. Wardwell Dr. Thomas S. Elleman In the Matter of Docket No. 50-271-LR ENTERGY NUCLEAR VERMONT YANKEE, LLC, and ASLBP No. 06-849-03-LR ENTERGY NUCLEAR OPERATIONS, INC.1 June 20, 2006 (Vermont Yankee Nuclear Power Station)

ORDER (Tentatively Scheduling Oral Argument)

On June 19, 2006, the Board held a prehearing telephone conference call to discuss, inter alia, an unopposed motion by the Department of Public Services of the State of Vermont to reschedule the oral argument tentatively scheduled for July 25 and 26, 2006.2 Representatives of the NRC staff, the applicants, and all petitioners/requestors except the Town of Marlboro, Vermont, participated in the conference call.3 After hearing from each of the participants, the Board ruled, inter alia, that oral argument, if necessary, will be held on Tuesday, August 1, 2006, and Wednesday, August 2, 2006, in or about Brattleboro, Vermont.

1 The license renewal application reflects that there are two applicants in this matter -

Entergy Nuclear Vermont Yankee, LLC, and Entergy Nuclear Operations, Inc. Accordingly, the caption has been corrected. All filings in this proceeding should use this corrected caption.

2 Vermont Department of Public Service Motion for Extension of Time and Alternative Dates for Oral Argument and Joint Motion with NEC for Extension of Time for the NRC Staff and NEC Filing Dates on the NEC Petition to Intervene (June 16, 2006).

3 Diligent efforts were made to contact representatives from the Town of Marlboro (which has not filed a Notice of Appearance as required by 10 C.F.R. § 2.314(b)).

The time and location of any such oral argument, as well as the sequence and organization of the presentations, will be set by a subsequent order.

It is so ORDERED.
