Dear Mr. Loeffler:

By letter dated December 12, 2012 (Agencywide Documents Access and Management System Accession No.

ML12356A473), Northern States Power Company - Minnesota, doing business as Xcel Energy, Inc., submitted a license amendment request to revise the emergency action level (EAL) RA1.2 to a value that is within the indication range of the Turbine Building Normal Waste Sump (radiation) monitor.

The U.S. Nuclear Regulatory Commission (NRC) staff in the Operating Reactor Licensing and Outreach Branch (ORLOB) of the Office of Nuclear Security and Incident Response is currently reviewing your submittal. The ORLOB staff has determined that additional information is required to complete its review. The draft requests for additional information (RAI) are attached.

You may accept this draft RAI as a formal Request for Additional Information and respond to the questions by May 17, 2013. The NRC staff suggests that the contents of the draft RAIs may want to be discussed in a conference call. Please coordinate any conference call, if desired, directly through me.

DRAFT REQUEST FOR ADDITIONAL INFORMATION REGARDING MONTICELLO NUCLEAR GENERATING PLANT LICENSE AMENDMENT REQUEST TO REVISE EMERGENCY PLAN EMERGENCY ACTION LEVEL RA1.2 NORTHERN STATES POWER COMPANY - MINNESOTA DOCKET NO. 50-263 (TAC NO. MF0461)

By letter dated December 21, 2012, Northern States Power Company - Minnesota, doing business as Xcel Energy, submitted a license amendment request for the Monticello Nuclear Generating Plant (Agencywide Documents Access and Management System Accession No.

ML12356A473). The proposed amendment would revise emergency action level (EAL) RA1.2 to a value that is within the indicating range of Turbine Building Normal Waste Sump (radiation) monitor.

The U.S. Nuclear Regulatory Commission staff in the Operating Reactor Licensing and Outreach Branch (ORLOB) of the Office of Nuclear Security and Incident Response requires additional information to facilitate its technical review. Timely and accurate response to these draft RAIs is requested.

The draft RAIs from the NRC staff are provided below.

1. Please discuss the mechanism to alert the EAL decision maker that a setpoint on the table associated with RA1.2 has been exceeded and to ensure that timely classification of the event is made?

2. The application indicates that the insufficient range of indication was documented in the corrective action program.

Please discuss whether an extent of condition evaluation was performed on the other radiation monitoring systems to determine if this condition exists elsewhere?

3. If an alarm setpoint has been exceeded, but the release path has been isolated, will the EAL be declared?

4. NRC Staff Comment - an enhancement to the effluent EALs would be to include the following information from the basis as a note to the EAL, The Emergency Director should not wait until 15 minutes has elapsed, but should declare the event as soon as it is determined that the release duration has or will likely exceed 15 minutes.
