nrc.g ov.SUPPLEMENTARY INFORMA TION: I.Introduction The U.S. Nucle ar Regulatory Commission (N RC) is cons idering granting a partial ex emption from the Recordk eeping requirement s of Title 10 of the Code of Federal Regulations (10 CFR)

Part 50.71(c); 10 CFR Part 50, Appendix A; 10 CFR Part 50, Appen dix B; an d 10 CFR 50.59(d)(3), f or the Yankee Nuclear Power Station (YNPS) as req uested by Yankee Atomic Electric Co mpany (YAEC or the Licen see) on Februa ry 15, 2006 , as supplemen ted on Ma rch 23, 20 06. An envi ronmen tal as sessme nt (EA) was performe d by the NR C staff i n supp ort of i ts revi ew o f the ex emptio n reque st. II.Environmental Ass essment

Background:

YNPS is a d eacti vated pressu rize d-wa ter nuc lear r eactor loca ted in northw estern Massachus etts in Frankli n County, n ear the southern Vermont border.

The YNPS pl ant was constructed between 1958 and 1960 and operated com mercially at 185 megawatts electric (after a 1963 upgrade) until 1992. In 1992, YA EC determined that closin g of the plant w ould be in the best economic interest of its customers. In December 1993, NRC amended the YNPS operating lic ense to retain a "possessio n-only" statu

s. YAEC be gan dismantlin g and decommissioning activities at that time. Transfe r of the spent fue l from the Spent Fuel Pit (SFP) to the Indepe ndent Spent Fuel Storage Instal latio n (ISFS I) wa s compl eted i n June 2003. W ith the exception of the great er than class C waste stored at the ISFSI, the rea ctor and all associated systems and component s, including those associated with storag e of spent fuel in the SFP, hav e been remov ed from the facility and dispo sed of offsite. In addi tion, the structu res ho using t hese s ystems and c ompone nts ha ve be en demo lish ed. Ph ysic al w ork associated w ith the decommi ssioning of YNP S is schedu led to be c ompleted in 2006.This Envi ronmental Asses sment (EA) has b een devel oped in ac cordance w ith the requirements of 10 CF R Part 51.21.

Proposed Acti on: Yankee Atomic E lectric Compa ny (YAEC) is requesting the followin g exemption, for reco rds pertaining to s ystems, structures, or components (SS Cs) and/or acti vities a ssociated w ith the nuclear pow er generating unit, Spent Fuel Pit, and asso ciated suppo rt systems, from the retention require ments of: (1) 10 CFR 50 Appendi x A Crite rion 1 w hich requires certain records be retained "throughout the li fe of the unit"; (2) 10 CFR 50 App endix B Criterion XVII w hich requires certain records be retai ned consiste nt with re gulatory requireme nts for a duration established by the l icensee; (3) 1 0 CFR 50.59 (d)(3) which requires certain records be maintained u ntil "terminati on of a licen se issued p ursuant to" Part 5 0; and (4) 10 CFR 50.71(c) which requi res records retenti on for the period specified i n the regulatio ns or until license termination.

Need for Proposed Action: The requ ested exemp tion a nd app lica tion o f the ex emptio n wi ll el imina te the require ment to maintain reco rds that are no longer necessary due to the p ermanently s hutdown sta tus of the faci li ty an d th ere by red uce the fin anc ia l b urd en on rat epa ye rs a sso cia ted wi th t he sto rag e o f a large volume of records.

Environmenta l Impacts of the Pro posed Action
