Dear Mr. Strauss and Ms. Baldwin: This letter responds to your Petition of September 18, 2007, requesting a hearing on the license transfer application submitted by Entergy Nuclear Operations, Inc. et al. The IVRC Staff is still reviewing the application and has not yet docketed it. Accordingly, the Commission has not yet issued a Federal Register notice of oppodunity for a hearing, which, under 'i 0 C.F.R. 3 2.31 8(a), marks the commencement of a proceeding. Therefore, there is not yet a proceeding in which the union can intervene. Pursuant to my authority under 10 C.F.R. 2.346(9'), 1 am returning your Petition at this time. You may file another petition to intervene and request for hearing once the opportunity for a hearing is published in a Federal Register notice.
