(2) W3P84-0505 dated February 29, 1984 Dear Sirt in your Reference (1) Intter you requented that I.PAI. provide a ncheduto committing to renolve the Staff concerna in regard to a potentini ningle failure vulnerability in the APS System. Specifically, to addrone the Staff'n concerna you requested,luntification aufficient to demonstrate that the Waterford APS design meets the critorin of BTP RSn 5-1, and the criteria for systemg required for atcam genorntor tuho rupturn (SCTR) necident mitigation.

An to the criterin of BTP RSR 5-1. Supplemant 5 to the Waterford SER (Section 5.4.3) indienten that we meet the ATP requirementn.

Furthermorn, Reference (2) transmitted CEN-259, "An ?. valuation of the Naturnt Circulation Cooldown Tcat Performod at the San Onofre Nuclear Generating Station: Comptinnce With the Tonting Requiremente of hranch Technical Position RSB 5-l".

While CEN-259 demonstrated the applienbility of tho SONCS naturni circulation /horon mixing tout to Watorford 3, it also reaf firmed our comptinnen with RTP RSB 5-1.

In particular it van demonstrated (in Sectiono 6.2 and 6.3) that the APS in not necennary for mooting the functionni requirements of BTP RSn 5-13 rather, in the unlikely event that the APS in unnvallable the finn 1 plant depreneurlantion enn be accomplished uning the safety-grado reactor coolant gna vent nyatom. Wo foot, therefore, that your requent for information on DTP RSH 5-1 han already been adequatcly mot and we have no plans for a further nuhmittal.

As to the APS/SGTR innuo. following discussions with your Mr. T. Marsh, the following schedule was agreed upon:

1.

An acceptabit justif fention for interim operation will be submitted to the NRC prior to exceeding 5% power.

2.

Resolution of the SGTR innue should be reached within six months of receipt of the low power operating license. liardware changen, if necennary, will be completed on a schedule to be negotinted at n intor time, however, not prior to the first refueling outage.

It in our understanding that these commitments will form the basin for n licenso condition for Watorford 3.

We request that the wording of the l

licongo condition be clear insofar as only the APS/SGTR napect of Reference I

(1) remaining for I.P&L action, and issuo "renolution" not requiring backfit implementation.
