The team identified a Green, non-cited vioThe team identified a Green, non-cited violation of 10 CFR Part 50, Appendix B, Criterion XII, Control of Measuring and Test Equipment, which states, Measures shall be established to assure that tools, gages, instruments, and other measuring and testing devices used in activities affecting quality are properly controlled, calibrated, and adjusted at specified periods to maintain accuracy within necessary limits. Specifically, since March 22, 1988, the licensee failed to establish measures to assure that the Class 1E Eagle 21 software tools and testing devices were properly controlled commensurate with their importance to the test and evaluation of the Class 1E integrated computer system, which ensures compliance with the functional, performance, and interface requirements of the system. In response to this issue, the licensee placed control of the tools and testing equipment under the nuclear quality assurance program. This violation was entered into the corrective action program as Condition Report CR 16-1985. The team determined that the failure to control software tools and testing devices used in activities affecting quality of the Class 1E Eagle 21 system was a performance deficiency. The performance deficiency was determined to be more than minor, and therefore a finding, because it would have the potential to lead to a more significant safety concern. Specifically, the failure to control the software tools and testing devices would lead to potential errors being introduced to these tools and the safety-related Eagle 21 system. In accordance with Inspection Manual Chapter 0609, Appendix A, The Significance Determination Process (SDP) for Findings At-Power, dated June 19, 2012, Exhibit 2, Mitigating Systems Screening Questions, the team determined the finding to be of very low safety significance (Green) because the finding was a deficiency affecting the design or qualification of a structure, system, or component, and the structure, system, or component maintained its operability or functionality. The team determined that this finding did not have a cross-cutting aspect because the most significant contributor did not reflect present licensee performance. not reflect present licensee performance.
