The unit was declared non-functional and Wolf Creek again entered Technical Specification 3.0.3 at 11:11 a.m. Wolf Creek requested a NOED that was granted by the NRC staff at 4:07 p.m. The inspectors reviewed the documentation, plant status information, the equipment history, as well as the Inspection Manual Chapter 0410 process. Consistent with NRC policy, the NRC agreed not to enforce compliance with the specific technical specifications in this instance, but will further review the cause(s) that created the apparent need for enforcement discretion to determine whether a violation of NRC requirements existed.
