Title 10 CFR Part 50, Appendix E, lV.D.3, … Title 10 CFR Part 50, Appendix E, lV.D.3, states that a licensee shall notify the state and local government agencies within 15 minutes after declaring an event. Contrary to the above, on June 8, 2015, the licensee did not notify the state and local government agencies within 15 minutes after declaring an event. Specifically, the licensee declared a notice of unusual event (NOUE) at 10:59 PM, but completed the notification to the state and local government agencies at 11:21 PM, or 22 minutes after the declaration of the NOUE. The finding was greater than minor because it is associated with the cornerstone attribute of Emergency Response Organization performance during actual event response and adversely affected the cornerstone objective to ensure that the licensee is capable of implementing adequate measures to protect the health and safety of the public in the event of a radiological emergency. Timely offsite notifications enable state and local agencies to make decisions for taking initial offsite response measures that could affect the general public. The inspectors determined the finding to be of very low safety significance (Green) because the failure to implement the emergency plan occurred during a notification of usual event.
