ALL AGREEMENT STATES, CONNECTICUT, INDIANA, AND WEST VIRGINIA PROPOSED RULE - FEE RECOVERY FOR FISCAL YEAR 2024 (STC-24-012)
Purpose:
This is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has published a proposed rule for comment, which would modify Title 10 of the Code of Federal Regulations (10 CFR) Parts 2, 15, 37, 73, 110, 140, 170 and 171 regarding the licensing, inspection, special project, and annual fees to recover approximately 100 percent of its Fiscal Year (FY) 2024 budget authority (less the budget authority for excluded activities).
Background:
These proposed amendments are necessary to comply with the Nuclear Energy Innovation and Modernization Act (NEIMA), which requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee recovery requirement. The proposed rule also includes a Schedule of Materials Fees for FY 2024. The comment period for the proposed rule closes on March 21, 2024, and comments received after this date will be considered if practicable.
Discussion: The NRC is issuing this FY 2024 proposed fee rule based on the FY 2024 budget request, because a full-year appropriation has not been enacted for FY 2024. The NRC will adjust the fees described in this proposed rule to reflect the enacted budget authority for FY 2024. As described in the FY 2024 Proposed Fee Rule, the NRC is proposing to increase the professional hourly rate from $300 to $321.
