ALL AGREEMENT STATES AND CONNECTICUT PROPOSED RULE - FEE RECOVERY FOR FISCAL YEAR 2021 (STC-21-011)
Purpose:
This is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has published a proposed rule for comment to modify Title 10 of the Code of Federal Regulations (10 CFR) Parts 170 and 171 regarding the licensing, inspection and annual fees to recover approximately 100 percent of its Fiscal Year (FY) 2021 budget authority.
Background:
These proposed amendments are necessary to implement the Nuclear Energy Innovation and Modernization Act (NEIMA), which, starting in FY 2021, requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee-recovery requirement. In addition, the NRC is also proposing improvements associated with fee invoicing to implement provisions in NEIMA. The proposed rule was published in the Federal Register on February 22, 2021 (Volume 86, Number 33, pages 10459 through 10490). The proposed rule assesses fees to those Agreement State licensees who perform work in Non-Agreement States under the reciprocity provisions of 10 CFR 150.20. For FY 2021, the proposed reciprocity fee is $2,700. The proposed rule also includes a Schedule of Materials Fees for FY2021 which contains changes from the published final FY 2020 fees. The comment period for the proposed rule closes on March 24, 2021, comments received after this date will be considered if practicable.
