20555-0001 December 10, 2020 ALL AGREEMENT AND NON-AGREEMENT STATES, STATE LIAISON OFFICERS NOTICE OF REQUEST FOR COMMENT: REVISED NRC ENFORCEMENT POLICY STATEMENT (STC-20-086)

Purpose:

To provide notification of the U.S. Nuclear Regulatory Commissions (NRCs) request for comment in the Federal Register relating to the revision of the NRC Enforcement Policy.

Background:

The NRC has issued for public comment a revision to the NRC Enforcement Policy. The NRC Enforcement Policy contains the basic process used to assess apparent violations of NRC regulations. The NRC is soliciting comments from interested parties including public interest groups, members of the public, States, and members of the regulated industry (e.g. reactor, fuel cycle, materials licensees, vendors, and contractors) to assist the NRC in revising its policy.

Discussion: The Federal Register Notice (FRN) was published in the Federal Register (85 FR 78046) on December 3, 2020, and posted on the Federal e-rulemaking portal http://www.regulations.gov under Docket No. NRC-2020-0261. The FRN can also be accessed at: https://www.regulations.gov/document?D=NRC-2020-0261-0001. The Draft NRC Enforcement Policy and Enforcement Policy Revision Summary are also available in the NRCs Agencywide Documents Access and Management System (ADAMS) under accession numbers ML20297A235 and ML20297A243, respectively.

Comments are requested by February 1, 2021. Comments received after this date will be considered if it is practical to do so, but the NRC is able to ensure consideration only for comments received before this date.
