UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 July 15, 2019 ALL AGREEMENT STATES, VERMONT FINAL RULE - FEE RECOVERY FOR FISCAL YEAR 2019 (STC-19-045)

Purpose:

This is to inform you that the U.S. Nuclear Regulatory Commission (NRC) has published a final rule to modify Title 10 of the Code of Federal Regulations (10 CFR)

Parts 170 and 171 regarding the licensing, inspection and annual fees to recover approximately 90 percent of its Fiscal Year (FY) 2019 budget authority.

Background:

These amendments are reviewed annually to support budget needs to implement the Omnibus Budget Reconciliation Act of 1990, as amended, which mandates that NRC recover through fees approximately 90 percent of its FY 2019 budget authority less the amount appropriated from the Waste Incidental to Reprocessing and generic homeland security activities. Please see the 2019 Fee Recovery Work Papers (ML19106A409) for the detailed financial analysis used to determine the final fees. The final rule was published in the Federal Register on May 17, 2019 (84 FR 22331-22362) and becomes effective July 16, 2019.

Discussion: The NRC is amending the flat application fees it charges to licensees to reflect an increase in the professional hourly rate to $278. Also see, Schedule of Materials Fees pages 22350-22356 for changes in the FY2019 materials fees. The final rule is no longer being printed but is available on the Federal eRulemaking Portal at:
