February 3, 2026 Week Ending: January 23, 2026 ENCLOSURE B Office of Nuclear Material Safety and Safeguards Items of Interest The U.S. Nuclear Regulatory Commission Staff Met with General Matter on Construction Under Part 70 On January 14, 2026, staff from the Office of Nuclear Material Safety and Safeguards, the Office of the General Counsel, and Region II met with General Matter to discuss the 10 CFR Part 70 licensing process and construction activities permitted under 10 CFR 70.4. During the open session, the staff provided an overview of the licensing timeline and oversight for construction, while the closed session focused on General Matters approach and interpretation of construction under Part 70. The staff is developing written responses to General Matters questions on construction activities allowed under regulation, while also considering their proposed date for application submittal and construction schedule.

Commercial Non-Power Production or Utilization Facilities; Notice of Interpretation; Request for Comment; 10 CFR Part 50 [NRC-2024-0189]

On January 20, 2026, the U.S. Nuclear Regulatory Commission (NRC) published a document in the Federal Register (91 FR 2287) issuing an interpretation of its regulations to include non-power production or utilization facilities (NPUFs) licensed under section 103 of the Atomic Energy Act of 1954, as amended (AEA), within the scope of the NRC's backfitting regulations and to exclude non-commercial NPUFs licensed under section 104 of the AEA from the scope of the NRC's backfitting regulations. The interpretation is effective January 20, 2026. Comments are requested by February 19, 2026.
