FOIA-2025-000461 Grod, Steven Tetra Tech Tetra Tech is performing a Phase I Environmental Site Assessment (ESA) of a property in Richmond CA and making a FOIA request: 2030 Wright Avenue, Richmond, Contra Costa County, CA 94804 Discovered during preliminary research, we discovered that a former occupant of the property (Eberline Services) was referenced on the USNRC website (see link: Eberline Services l NRC.gov).

There was reference to a license number (0023-

07) and a Characterization Survey Report submitted in February 2017. Also discovered during preliminary research were two listings from the historic Material Licensing Tracking System (MLTS) database for LFE Corporation at 2030 Wright Avenue. There were references to different dockets and license numbers (see attached PDF files as well): First listing: Docket 7000561; License Number SNM-359 Second listing: Docket 3003604; License Number 04-00911-03 I am requesting copies (preferably electronic/PDF) of environmental records the USNRC may have for the property including the dockets, licenses, and Characterization Survey Report mentioned above, as well as records pertaining to history of operations at the property, hazardous materials/wastes, inspections, notices to comply/notices of violation, and previous investigation/survey and remediation reports.

Office of Nuclear Reactor Regulation Items of Interest Week Ending March 21, 2025 NRC Issued a Letter to Oklo Informing Them That the Staff Plans to Begin a Limited Scope Readiness Assessment for Phase 1 of its Forthcoming Combined License Application for the Aurora Powerhouse Advanced Reactor On March 19, 2025, the U.S. Nuclear Regulatory Commission (NRC) issued a letter (Agencywide Documents Access and Management System (ADAMS) Accession No. ML25057A385) to Oklo informing them that the staff plans to begin a limited scope readiness assessment for phase 1 of its forthcoming combined license application for the Aurora powerhouse advanced reactor. The assessment will begin on March 31, 2025. Phase 1 will include the environmental report, characteristics of the proposed site, postulated fission product release, and company and financial information. Following the assessment, the staff plans to issue a report which will identify information gaps that could impact the technical review or docketing of the application.

NRR Held a Hybrid Public Meeting with NextEra Energy, LLC, for NextEra to Provide an Overview of Their Plan to Potentially Restart the Duane Arnold Energy Center by the End of 2028 On March 19, 2025, the Office of Nuclear Reactor Regulation (NRR) held a hybrid public meeting with NextEra Energy, LLC (NextEra), for NextEra to provide an overview of their plan to potentially restart the Duane Arnold Energy Center by the end of Calendar Year (CY) 2028.

Topics included current facility status, consideration of restart, facility work, regulatory path/schedule for submittals, and staffing and qualifications. On January 23, 2025, NextEra submitted an exemption request to restore the operating licensing basis using an exemption to 10 CFR 50.82(a)(2). NextEra stated between now and the first quarter of CY26, they plan on submitting 1) a license amendment to restore technical specifications, 2) an updated final safety analysis report, 3) an operator licensing program outline, 4) security, cybersecurity, emergency, and transitional quality assurance program plans, and 5) an application for subsequent license renewal, including environmental reviews. The meeting was attended by about 140 people.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending March 21, 2025 List of Approved Spent Fuel Storage Casks: Holtec International HI-STORM UMAX Canister Storage System, Certificate of Compliance No. 1040, Revision 1 to Amendment Nos. 0 Through 2; Direct Final Rule; Confirmation of Effective Date; 10 CFR 72 (NRC-2024-0182; RIN 3150-AL22)

On March 19, 2025, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (90 FR 12679) confirming the effective date of April 21, 2025, for the direct final rule that was published in the Federal Register (90 FR 8861) on February 4, 2025. The direct final rule amended the NRC's spent fuel storage regulations by revising the Holtec International HI-STORM UMAX Canister Storage System listing within the List of approved spent fuel storage casks to include Revision 1 to Amendment Nos. 0 through 2 to Certificate of Compliance (CoC) No. 1040. The effective date of April 21, 2025, for the direct final rule published February 4, 2025, is confirmed.

On March 20, 2025, the NRC published a notice in the Federal Register (90 FR 13047) amending its spent fuel storage regulations by revising the NAC International, Inc.

MAGNASTOR Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 15 to Certificate of Compliance No. 1031. Amendment No. 15 revises the certificate of compliance to add a new variation of the Lightweight MAGNASTOR Transfer Cask design, add a new concrete cask design, increase the maximum system heat load capacity, add new loading patterns, add a thermal shunt for short loading patterns, remove the 5 percent burnup penalty, increase Passive MAGNASTOR Transfer Cask heat load, add two new pressurized-water reactor fuel types to support future operations, modify the transportable storage canister lid to allow additional clearance near the top center of the basket, and correct and clarify principal design criteria, operating procedures, and the acceptance criteria and maintenance program. Comments are requested by April 21, 2025. The companion proposed rule was also published in the Federal Register on March 20, 2025 (90 FR 13103). The direct final rule is effective June 3, 2025.

NRC Staff Make Presentation on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management in Vienna, Austria On March 18, 2025, the United States (U.S.) presented its National Report at the Eighth Review Meeting of the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management in Vienna, Austria. The U.S. presentation was delivered by Jennifer Whitman, Deputy Director, Division of Decommissioning, Uranium Recovery and Waste Programs, Office of Nuclear Material Safety and Safeguards (NMSS) and Paul Murray, Deputy Assistant Secretary, Office of Nuclear Energy, Department of Energy, U.S. Department of Energy (DOE). Jordan Swarthout, Foreign Affairs Officer, Office of Nuclear Energy, Safety and Security, U.S. Department of State, and Head of Delegation, provided opening remarks.

The U.S. presentation was well-received, and representatives responded to approximately 20 questions and comments from Contracting Parties. Topics of interest included consolidated interim storage facilities for spent fuel; artificial intelligence; the ADVANCE Act; high burnup fuel research cask; DOE package performance project; disposal of Greater-than-Class-C waste including related NRC rulemaking activities; the status of DOE cleanup activities for legacy sites; the NRC Agreement State program; and DOE taxpayer liability for spent fuel. After the U.S. presentation, Country Group Officers recognized the U.S. Risk Tool for dry cask storage systems as a Good Practice and preparations for safe AI deployment as an Area of Good Performance.
