Office of Nuclear Reactor Regulation Items of Interest Week Ending March 8, 2024 Notice of Enforcement Discretion request for Seabrook Unit 1 On March 3,2024, the U.S. Nuclear Regulatory Commission staff verbally approved a Notice of Enforcement Discretion (NOED) request for Seabrook Unit 1 to address a failed reserve auxiliary transformer. The NOED extends the Limiting Condition for Operation (LCO) for 5 days beyond their 72-hour limit that expired on March 4, 2024, at 5:42 a.m. to allow the licensee to submit an emergency license amendment request (LAR). The emergency LAR will request that the 72-hour LCO be extended to 30 days to facilitate a transformer replacement at power.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending March 8, 2024 Advance Tribal Notification of Category 1 Quantities of Radioactive Material Shipments:
Proposed Rule; 10 CFR Part 37 [NRC-2022-0191; RIN 3150-AK90]
On March 8, 2024, the U.S. Nuclear Regulatory Commission (NRC) published a proposed rule in the Federal Register (89 FR 16701) proposing to amend its regulations to require NRC and Agreement State licensees to provide advance notification to participating federally recognized Tribal governments regarding shipments of category 1 quantities of radioactive material that pass within or across their reservation boundaries. The proposed rule would resolve a petition for rulemaking (PRM-37-2) requesting changes to the regulations to include advance Tribal notification requirements similar to existing State notification requirements. The NRC will hold a public meeting during the public comment period to promote full understanding of the proposed rule and facilitate public comments. Comments are requested by May 22, 2024.
