Items of Interest Week Ending January 6, 2023 Alternatives to the Use of Credit Ratings: Proposed Rule; 10 CFR Parts 30, 40, 50, 70, and 72 [NRC-2017-0021; RIN 3150-AJ92]

On January 3, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a proposed rule in the Federal Register (88 FR 25) that would amend regulations for approved financial assurance mechanisms for decommissioning, specifically for parent and self-company guarantees that require bond ratings issued by credit rating agencies. The proposed rule would implement the provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 that directed agencies to amend their regulations to remove any reference to or requirement of reliance on credit ratings. The proposed rule affects applicants and licensees who are required to provide decommissioning financial assurance. The NRC will hold a public meeting to promote full understanding of the contemplated action and facilitate public comment.

The comment period ends March 20, 2023.

Completion of NUREG-2243, Environmental Impact Statement for the Disposal of Mine Waste at the United Nuclear Corporation Mill Site in McKinley, New Mexico Final Report On January 4, 2023, the NRC staff completed NUREG-2243, Final Environmental Impact Statement (EIS) for Disposal of Mine Waste at the United Nuclear Corporation (UNC) Mill Site in New Mexico (Agencywide Documents Access and Management System Accession No. ML22356A145). The EIS assesses the potential environmental impacts of a proposal by UNC to dispose of waste from the Northeast Church Rock mine site at its NRC-licensed mill tailings site in McKinley County, NM. The Final EIS was made publicly available on January 4th and a Federal Register Notice will be published on January 13th. Staff expects to make a licensing decision and issue the Record of Decision in mid-February. Staff is also publishing a Programmatic Agreement (PA) under Section 106 of the National Historic Preservation Act (ML22074A047). The PA ensures that cultural properties would be protected during project activities and is included in Appendix A of the Final EIS.

List of Approved Spent Fuel Storage Casks: Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System, Certificate of Compliance No. 1032, Amendment No. 6: Direct Final Rule; 10 CFR Part 72 [NRC-2022-0181; RIN 3150-AK88]

On January 6, 2023, the NRC published a direct final rule in the Federal Register (88 FR 949) amending its spent fuel storage regulations by revising the Holtec International Storage Module Flood/Wind (HI-STORM FW) multipurpose Canister Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 6 to Certificate of Compliance No. 1032. Amendment No. 6 revises and clarifies design and operational requirements in the certificate of compliance for the HI-STORM FW overpack. The companion proposed rule was also published in the Federal Register on January 6, 2023 (88 FR 1010).

This direct final rule is effective February 6, 2023.
