Items of Interest Week Ending November 11, 2022 NRC Holds Public Meeting with the Nuclear Energy Institute Regulatory Issues Task Force On November 8, 2022, the U.S. Nuclear Regulatory Commission (NRC) held a hybrid public meeting with the Nuclear Energy Institute Regulatory Issues Task Force to provide feedback on regulatory issues. Topics included the Innovation/EMBARK Update on MAP-X, the Risk-informed Process for Evaluations, the Request for Confirmation of Information Process overview, the Effort and Schedule Estimate Tool overview, the Status of Radioactive Source Security and Accountability Rulemaking, and the 2023 Regulatory Information Conference.

There were over 45 NRC, industry, and public attendees. The NRC presentation slides are available at Agencywide Documents Access and Management System Accession No. ML22307A272.

Items of Interest Week Ending November 11, 2022 Reporting Requirements for Nonemergency Events at Nuclear Power Plants: Regulatory Basis; Request for Comment; 10 CFR Part 50 [NRC-2020-0036; RIN 3150-AK71]

On November 9, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 67571) requesting comment on a regulatory basis to support a rulemaking that would amend its regulations for nonemergency event notifications. The NRC is evaluating the current requirements and guidance for immediate notification of nonemergency events for operating nuclear power reactors and assessing whether the requirements present an unnecessary reporting burden. The regulatory basis contains an analysis of whether reporting requirements can be reduced or eliminated when they do not have a commensurate safety benefit. Public comments by are due by January 9, 2023.

Advance Tribal Notification of Certain Radioactive Material Shipments: Petition for Rulemaking; Consideration in the Rulemaking Process; 10 CFR Part 37 (Docket No.

PRM-37-2; NRC-2021-0051)

On November 8, 2022, the NRC published a notice in the Federal Register (87 FR 67399) announcing that it will consider in its rulemaking process the issue raised in a petition for rulemaking, PRM-37-2, submitted by Richard Arnold and Ron Johnson, on behalf of the Tribal Radioactive Materials Transportation Committee, dated December 4, 2020. The petitioner requests that the NRC amend its regulations to include advance Tribal notification of certain radioactive material shipments. The docket for PRM-37-2 closed on November 8, 2022.

Issued Exemption to Holtec Decommissioning International, LLC to Support Decommissioning Activities at Indian Point Units 2 and 3 On November 7, 2022, the staff issued an exemption to Holtec Decommissioning International (ML22217A014) to support decommissioning activities at Indian Point Units 2 and 3. Holtec Decommissioning International submitted the exemption request on behalf of Holtec Indian Point 2, LLC and Holtec Indian Point 3, LLC on March 24, 2022. The exemption authorizes loading up to three multipurpose canisters with more Neutron Source Assemblies than is currently authorized by Certificate of Compliance No. 1014. The letter and safety evaluation report will become publicly available on November 14, 2022.
