Items of Interest Week Ending October 28, 2022 NRC Staff Holds Stakeholder Outreach Meeting Regarding Common-Cause-Failure for Digital Instrumentation and Control Systems On October 20, 2022, the NRR staff held its third stakeholder outreach meeting to inform and solicit external stakeholders feedback on the staffs SECY-22-0076 regarding expansion of the current U.S. Nuclear Regulatory Commission (NRC) policy for addressing common-cause-failure for digital instrumentation and control systems. The NRR staff presented recent activities and the status of SECY-22-0076, including its position on diverse and independent main control room displays and manual controls. The staffs presentation is included in Agencywide Documents Access and Management System (ADAMS) Accession No. ML22291A015. The NRR staff engaged the stakeholders in robust discussion and received their differing perspectives on the need for diverse and independent manual controls and displays for critical safety functions which are necessary to maintain plant safety. The NRC staff provided SECY-22-0076 to the Commission in August for voting.
NRC Staff and Technical Specifications Task Force Hold Public Workshop Regarding Natural Phenomena Protection On October 20, 2022, NRR staff and the industry-led Technical Specifications Task Force (TSTF) conducted a public workshop to discuss the relationship between natural phenomena protection design features and technical specification operability (ML22290A125). The TSTF requested this workshop (ML22189A144). Discussion included how the General Design Requirements, Title 10 of the Code of Federal Regulations 50.36, "Technical Specifications" requirements, and operability requirements relate to protection from various natural phenomena (specifically external flooding, high winds, tornado missiles, and earthquakes). The focus of this initial meeting was to scope the potential problem and discuss industry and staff experiences.
Follow-up meetings will be scheduled to continue these discussions in more detail and develop options for establishing durable guidance on this issue.
NRC Staff and Technical Specifications Task Force Hold Public Workshop Regarding Strategic Improvement Initiative On October 24, 2022, NRR staff and the industry-led Technical Specifications Task Force (TSTF) conducted a public workshop to discuss the TSTF's Strategic Improvement Initiative for technical specifications and license amendments (ML22291A196). The TSTF presented the results of an industry-wide survey and workshop in the format of a consolidated set of possible improvements for further discussion. These were binned as either technical specification improvements that would require rulemaking, technical specification improvements that could be done without rulemaking, and related improvements to license amendment submission and review processes. NRR staff provided suggestions and comments and participated in a discussion of possible next steps. Follow on meetings will be scheduled on several topics including converting technical specifications from a paper-based to a data-based format, conducting a lessons-learned workshop on risk-informed technical specifications, and modernizing licensing processes at the NRC and in licensee organizations.

NRC Meets with ARC Clean Technology On October 26, 2022, the NRC staff held a closed, pre-application meeting with ARC Clean Technology, Inc. (ARC). This was the first meeting between the NRC staff and ARC to discuss ARCs conceptual, advanced reactor design for the ARC-100. The ARC-100 is a 100 MWe (286 MWt), metal fueled, low pressure pool type, sodium cooled fast reactor design. ARC proposed a series of pre-application discussions over the next two years on specific aspects of the design but has not yet made a decision on the timing or type of future license applications. In 2020, the company was awarded $27.5M (over three and a half years) from the Department of Energy to support development of the ARC-100 as part of the Advanced Reactor Demonstration Program.

On October 27, 2022, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (87 FR 65127) amending its regulations to incorporate by reference the 2019 Edition of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code,Section III, Division 1, and Section XI, Division 1, and the 2020 Edition of the ASME Operation and Maintenance of Nuclear Power Plants, Division 1: OM Code: Section IST, for nuclear power plants. The NRC is also incorporating by reference the ASME OM Code Case OMN-28, Alternative Valve Position Verification Approach to Satisfy ISTC-3700 for Valves Not Susceptible to Stem-Disk Separation; the 2011 Addenda to ASME NQA-1-2008, Quality Assurance Requirements for Nuclear Facility Applications (ASME NQA-1b-2011); and the 2012 and 2015 Editions of ASME NQA-1, Quality Assurance Requirements for Nuclear Facility Applications. This action is in accordance with the NRCs policy to periodically update the regulations to incorporate by reference new editions of the ASME Codes and is intended to maintain the safety of nuclear power plants and to make NRC activities more effective and efficient. This final rule is effective on November 28, 2022.
Harmonization of Transportation Safety Requirements with IAEA Standards: Proposed Rule and Guidance; Extension of Comment Period and Correcting Supplement; 10 CFR Part 71 (NRC-2016-0179; RIN 3150-AJ85)
On October 28, 2022, the NRC published a notice in the Federal Register (87 FR 65177) correcting a document that was published in the Federal Register on September 12, 2022 (87 FR 55708), regarding changes to maintain a consistent regulatory framework with the U.S.
Department of Transportation for the domestic packaging and transportation of radioactive material and to ensure general accord with International Atomic Energy Agency standards. This action is necessary to make corrections in the estimated burden for the information collection and to make other corrections. The public comment period on the amended information collection was originally scheduled to close on November 14, 2022. The NRC has decided to extend the public comment period for the information collection to allow more time for members of the public to develop and submit their comments; the extended comment period for the information collection now aligns with the end of the general period for public comment. The due date of comments on the amended information collection requested in the document published on September 12, 2022, is extended. Comments on the amended information collection should be filed no later than November 28, 2022.
