Dear Richard Arnold and Ron Johnson:
This letter is in response to the petition for rulemaking (PRM) that you submitted to the U.S. Nuclear Regulatory Commission (NRC) on behalf of the Tribal Radioactive Materials Transportation Committee dated December 4, 2020 (Agencywide Documents Access and Management System Accession No. ML21042B011). In the PRM, you requested that the NRC revise its regulations in Part 37 of Title 10 of the Code of Federal Regulations (10 CFR),
Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material, to ensure consistency to 10 CFR Part 71, Packaging and Transportation of Radioactive Material, and 10 CFR Part 73, Physical Protection of Plants and Materials, regarding advance Tribal notification of certain radioactive material shipments. The NRC docketed your petition on February 11, 2021, under Docket No. PRM-37-2.
The NRC published a notice of docketing and request for comment in the Federal Register on April 9, 2021 (86 FR 18477). The comment period closed on June 23, 2021, and the NRC received 10 public comments on the petition.
The NRC has reviewed your petition and the public comments. For the reasons provided in the enclosed notice, the NRC will evaluate its current regulations within the rulemaking process, with the goal of ensuring consistency regarding advance Tribal notification of certain radioactive material shipments between 10 CFR Part 37, 10 CFR Part 71, and 10 Part CFR 73.
