FRIDAY, JULY 15, 2022, VIA PUBLIC TELECONFERENCE I. SECY-21-0099 - ENTERGY NUCLEAR OPERATIONS, INC., ENTERGY NUCLEAR PALISADES, LLC, HOLTEC INTERNATIONAL, AND HOLTEC DECOMMISSIONING INTERNATIONAL, LLC (PALISADES NUCLEAR PLANT AND BIG ROCK POINT)

The Commission approved a Memorandum and Order addressing a petition for leave to intervene and request for a hearing filed in this proceeding by the Michigan Attorney General; Beyond Nuclear, Michigan Safe Energy Future, and Dont Waste Michigan; the Environmental Law & Policy Center; and Mr. Mark Muhich. This proceeding concerns a license transfer application involving the renewed facility operating license for the Palisades Nuclear Plant, the general license for the Palisades Independent Spent Fuel Storage Installation, the facility operating license for Big Rock Point, and the general license for the Big Rock Point Independent Spent Fuel Storage Installation. Entergy Nuclear Operations, Inc., Entergy Nuclear Palisades, LLC, Holtec International, and Holtec Decommissioning International, LLC seek NRC approval of the indirect transfer of control of the licenses to Holtec International and of the transfer of operating authority to Holtec Decommissioning International to conduct decommissioning and spent fuel management activities at the sites. They also seek NRC approval of conforming administrative license amendments to reflect the requested transfers. The Memorandum and Order grants the Attorney General of Michigans request for hearing; admits one financial qualifications contention encompassing four distinct disputes; and denies the other requests for hearing. The Commission further directs the Chief Administrative Judge of the Atomic Safety and Licensing Board Panel to appoint a single administrative judge as Presiding Officer to take all necessary actions to compile, complete, and certify the hearing record to the Commission.

(Subsequently, on July 15, 2022, the Secretary signed the Memorandum and Order.

2 II. SECY-22-0055 - ENERGYSOLUTIONS, LLC - INDIRECT LICENSE TRANSFER (ZION NUCLEAR POWER STATION, UNITS 1 AND 2; THREE MILE ISLAND NUCLEAR STATION, UNIT 2; LA CROSSE BOILING WATER REACTOR; KEWAUNEE POWER STATION; RADIOACTIVE MATERIALS LICENSE; EXPORT LICENSES)

The Commission approved a Memorandum and Order addressing a petition for leave to intervene and request for hearing filed in this proceeding by Mr. Eric Epstein. The proceeding concerns a license transfer application submitted by EnergySolutions, LLC. The application involves four facilities and several licenses; however, Mr. Epsteins petition focuses on Three Mile Island Nuclear Station, Unit 2. The Memorandum and Order denies Mr. Epsteins request and terminates the proceeding.
