Items of Interest Week Ending December 17, 2021 NRC Issues Order Approving Palisades and Big Rock Point License Transfers On December 13, 2021, the U.S. Nuclear Regulatory Commission (NRC) issued an order (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21292A155) approving the transfer of the Palisades and Big Rock Point licenses from Entergy Nuclear Operations to Holtec International, as owner, and Holtec Decommissioning International, as decommissioning operator. The NRC order is effective immediately, but the license transfer will not be finalized until after Palisades is permanently shutdown which is projected for May 2022. The order approving the transfer includes a condition that the transfer is subject to the Commissions authority to rescind, modify, or condition the action based on the outcome of hearings. Separate hearing requests were filed by: (1) the State of Michigan; (2) the Environmental Law and Policy Center; (3) Beyond Nuclear, Michigan Safe Energy Future, and Dont Waste Michigan; and (4) Mark Muhich.

NRC Issues Seismic Hazard Evaluations Document On December 13, 2021, the NRC staff issued NUREG/KM-0017, Seismic Hazard Evaluations for U.S. Nuclear Power Plants: Near-Term Task Force Recommendation 2.1 Results (ADAMS Accession No. ML21344A126). This document presents the Near-Term Task Force Recommendation 2.1 geologic profiles and site response results that were revised based on additional research conducted by the NRC staff. This NUREG/KM will support upcoming interactions with the Electric Power Research Institute, Nuclear Energy Institute, and current reactor licensees on seismic hazards for the operating fleet.

NRC Publishes Federal Register Notice Requesting Comments on Construction Permit Interim Staff Guidance On December 14, 2021, the staff published a notice in the Federal Register requesting comments on the draft Interim Staff Guidance (ISG), DNRL-ISG-2022-XX, "Safety Review of Light-Water Power-Reactor Construction Permit Applications" (86 FR 71101). The purpose of this ISG is to clarify existing guidance and to assist the staff in determining whether an application to construct a light-water power-reactor facility meets the minimum requirements to issue a construction permit. The FRN requests comments during a 45-day public comment period ending January 28, 2022. The staff expects to issue the final ISG in Fall 2022.

NRC Grants Exemption to R.E. Ginna Nuclear Power Plant On December 15, 2021, the NRC granted an exemption (ADAMS Accession No. ML21344A206) to Exelon Generation Company, LLC for R. E. Ginna Nuclear Power Plant from specific requirements of Title 10 of the Code of Federal Regulations Part 50, Appendix E,Section IV.F.2.c related to calendar year 2021 biennial emergency planning exercises. This request is a result of the impact of Tropical Storms/Hurricanes Henri and Ida, in conjunction with the continued effects of the COVID-19 public health emergency on availability of offsite response organizations to support the exercise.

Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2020-0134; RIN 3150-AK67]

On December 15, 2021, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (86 FR 71129) confirming the effective date of January 19, 2022, for the direct final rule that was published in the Federal Register (86 FR 61047) on November 5, 2021.

This direct final rule amends the TN Americas LLC, TN-32 Dry Storage Cask listing in the List of approved spent fuel storage casks to renew, for an additional 40 years, the initial certificate and Amendment No. 1 of Certificate of Compliance No. 1021. The effective date of January 19, 2022, for the direct final rule published on November 5, 2021, is confirmed.

Direct Final Rule to Amend 10 CFR Parts 11, 25, and 95 to Increase the Access Authorization Fees Charges to Licensees for Work Performed under the MAAP and IAAP On December 13, the Executive Director for Operations signed a direct final rule (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20211L870) and a companion proposed rule (ADAMS Accession No. ML20211L871) to amend Title 10 of the Code of Federal Regulations Parts 11, 25, and 95 to increase the access authorization fees charged to licensees for work performed under the Material Access Authorization Program (MAAP) and the Information Access Authority Program (IAAP) from 55.8 percent of the Defense Counterintelligence and Security Agency investigation billing rates to 90.2 percent. In addition, MAAP and IAAP requests for reciprocity will be charged a flat fee rate of $95.00. The direct final rule also makes two administrative changes to revise definitions to include new naming conventions for background investigation case types and to clarify the electronic process for completing security forms. The direct final rule and companion proposed rule will be forwarded to the Office of the Federal Register on December 21, 2021 for publication on or about December 28, 2021.
