Items of Interest Week Ending JULY 30, 2021 NRC Received Congressional Review Act Non-major Rule Determination for Revision 1 of Draft Guidelines for Characterizing the Safety Impact of Issues On July 27, 2021, the NRC staff received the Congressional Review Act non-major rule determination from the Office of Management and Budget for the Draft Guidelines for Characterizing the Safety Impact of Issues, Revision 1 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21180A014). The update reflects the successful expansion of Risk-Informed Process for Evaluations (RIPE) to include additional reactor licensees who have approved TSTF-425, Surveillance Frequency Control Program (ML090850627) license amendments. The guidance is now publicly available.

NRC Issued Closeout Letter for Bulletin 2012-01, Design Vulnerability in Electric Power System, for Callaway Plant, Unit 1 On July 27, 2021, the NRC staff issued a closeout letter (ADAMS Accession No. ML21201A105) for Bulletin 2012-01, Design Vulnerability in Electric Power System, (ADAMS Accession No. ML12074A115) for Callaway Plant, Unit 1 (Callaway). The NRC staff reviewed the information submitted by Ameren Missouri (the licensee) and the results of NRCs TI 2515/194 inspection for Callaway in reaching the closeout conclusion.

NRC Observed Third Intermediate Design Review for Project Pele On July 26 and 28, 2021, the NRC staff observed the third intermediate design review for Project Pele (https://www.cto.mil/pele_eis/), the Department of Defense/Strategic Capabilities Office (DoD/SCO) mobile nuclear reactor design competition. Teams led by BWXT and X-energy, presented their preliminary engineering designs to DoD/SCO staff and their subject matter experts. The goal of Project Pele is to have a demonstration mobile nuclear reactor, authorized by the Department of Energy, operating by the end of 2023.

NRC Approved Risk-informed Resolution of Generic Safety Issue 191 for Southern Nuclear Operating Company for Vogtle Electric Generating Plant, Units 1 and 2 On July 30, 2021, the NRC staff issued an amendment and exemption (ADAMS Accession Nos.

ML21068A109 and ML21071A050) to Southern Nuclear Operating Company for Vogtle Electric Generating Plant, Units 1 and 2, approving the risk-informed resolution of Generic Safety Issue 191, Assessment of Debris Accumulation on Pressurized-Water Reactor Sump Performance.

The Technical Specification (TS) changes follow Technical Specification Task Force (TSTF)-

567, Revision 1, Add Containment Sump TS to Address GSI-191 Issues, and add a new TS 3.6.7, Containment Sump, to address the condition of the containment sump made inoperable due to containment accident generated and transported debris exceeding the analyzed limits.

Items of Interest Week Ending JULY 30, 2021 Receipts-Based NRC Size Standards: Proposed Rule; 10 CFR Parts 2 and 171

On July 26, 2021, the NRC published a notice in the Federal Register (86 FR 39980) proposing to amend its small business size standards, which are used to qualify an NRC licensee as a small entity under the Regulatory Flexibility Act of 1980, as amended. The purpose of these size standards is for reducing annual NRC license fees for small entities. These standards do not apply to NRC contracting for goods and services. The NRC is proposing to increase the upper and lower tiers for its receipts-based small entity size standards for small businesses and small not-for-profit organizations. This change will allow NRC standards to remain consistent with the inflation adjustments made by the Small Business Administration. In addition, in accordance with the Small Business Runway Extension Act of 2018, the NRC is proposing to change the calculation of annual average receipts for the receipts-based NRC size standard for small businesses that provide a service or small businesses not engaged in manufacturing from a 3-year averaging period to a 5-year averaging period. Comments are requested by August 25, 2021.

Revisions to Reprocessing Plant Components for Export: Final Rule; 10 CFR 110

[NRC-2021-0026; RIN 3150-AK60]

On July 27, 2021, the NRC published a notice in the Federal Register (86 FR 40141) amending its export regulations pertaining to the illustrative list of reprocessing plant components under the NRCs export licensing authority. This final rule is necessary to conform the export controls of the United States to the international export control guidelines of the Nuclear Suppliers Group, of which the United States is a member. These changes will align the NRC's requirements with the current version of the International Atomic Energy Agencys document, Guidelines for Nuclear Transfers (INFCIRC/254/Part 1/Revision 14). This final rule was effective on July 27, 2021.

NRC Staff Held Public Meeting on Indian Point Post-Shutdown Decommissioning Activities Report On July 29, 2021, the NRC staff held a public meeting to obtain public comments on the Holtec Indian Point Post-Shutdown Decommissioning Activities Report. More than 60 members of the public attended in person, with 27 providing comments. The NRC staff established a bridge-line, which had 109 participants, to allow individuals to participate remotely. Local storms and technical issues with the telecommunications carrier and equipment resulted in remote participants not being able to connect to the public meeting. The NRC staff is evaluating having a follow up virtual meeting for those who were on the bridge line to obtain their comments. The comment period ends on October 22, 2021.

NRC Staff Denied Request for Access to Safeguards and Proprietary Information On July 29, 2021, the NRC denied a request for access (Agencywide Documents Access and Management System Accession No. ML21209A761) to the NuScale design certification (86 FR 34999) safeguards (SGI) and proprietary information. On July 19, 2021, a member of the public filed a late request for access to SGI and proprietary information for the purposes of providing public comments involving physical security, acts of terrorism, sabotage, insider threat, vehicle and aircraft impacts, and certain beyond design basis accidents. The requester failed to provide a legitimate and necessary need to access the information based on lack of specific information requested and the sufficient publicly available information already available to make meaningful public comments on the proposed rule.

Spent Fuel Reprocessing: Discontinuation of Rulemaking Activity; 10 CFR Parts 50 and 70 [NRC-2015-0016; RIN 3150-AJ53]

On July 29, 2021, the NRC published a notice in the Federal Register (86 FR 40764) discontinuing a rulemaking activity that would have amended the NRC's regulations to add a new part to the existing regulatory framework specific to nuclear spent fuel reprocessing facilities. The purpose of this action is to inform members of the public that this rulemaking activity is being discontinued and to provide a brief discussion of the NRC's decision. This rulemaking activity will no longer be reported in the NRC's portion of the Unified Agenda of Regulatory and Deregulatory Actions (the Unified Agenda). As of July 29, 2021, the rulemaking activity is discontinued.

NRC Issued Draft Environmental Impact Statement for Westinghouse Facility On July 30, 2021, the NRC staff issued the draft Environmental Impact Statement (DEIS) for Westinghouse Electric Company, LLCs request to renew its operating license for the Columbia Fuel Fabrication Facility in Hopkins, South Carolina, for an additional 40 years. A 45-day public comment period on the DEIS will begin upon issuance of the United States Environmental Protection Agencys Notice of Availability in the Federal Register, which is expected to be issued on August 6, 2021. The NRC staff plans to conduct a virtual public meeting on August 26, 2021 to receive comments on the DEIS.

Items of Interest Week Ending JULY 30, 2021 During the week of July 26, 2021, the Environmental Justice Review Team met with the public and several groups in the State of South Carolina, both in person and virtually, as part of their effort to engage stakeholders representing a broad range of perspectives. Staff Requirements Memorandum M210218B Briefing on Equal Employment Opportunity, Affirmative Employment, and Small Business, 10:00 A.M., Thursday, February 18, 2021, Video Conference Meeting, dated April 23, 2021 (Agencywide Documents Access and Management System Accession No. ML21113A070) directed the staff to perform outreach to gather a broad range of perspectives on the NRCs environmental justice program. During the meetings, participants expressed concerns including communication challenges, demographic changes, and mobility issues that the NRC should consider. The Team is continuing its outreach to other stakeholders.

Items of Interest Week Ending JULY 30, 2021 NRC Awarded Contract for Historical Classified Document Reviews for Declassification On July 26, 2021, contract number 31310021C0013 was awarded to Red Heritage Media, LLC, in Rock Hill, SC. The purpose of this contract is to conduct reviews of historical classified documents eligible for automatic declassification in order to assess what should remain classified and what can be declassified. The period of performance is from July 26, 2021 through July 25, 2022 with four (4) option periods. The total potential value of the contract can be up to $2,966,741.60.

NRC Awarded Contract for Onsite Clerical, Secretarial, and Administrative Assistance Support Services On July 23, 2021, contract number 31310021D0003 was awarded to Eagle Integrated Services, LLC, in San Antonio, TX. The purpose of this contract is to acquire nonpersonal clerical, secretarial, and administrative support services for NRC offices at all NRC locations on an as-needed basis. The period of performance is from July 22, 2021 through July 24, 2026 with no option periods. The total potential value of the contract can be up to $22,000,000.
