SECY-21-0070 - FIRSTENERGY COMPANIES AND TMI-2 SOLUTIONS, LLC (THREE MILE ISLAND NUCLEAR STATION, UNIT 2), PETITION FOR RECONSIDERATION OF CLI218 The Commission approved a Memorandum and Order addressing a Petition for Reconsideration of the Commissions decision in CLI-21-8 filed by Eric Epstein, Chairman of Three Mile Island Alert. The Commission in CLI218 denied TMIAs motion to hold the Three Mile Island Nuclear Station, Unit 2 license transfer in abeyance, after concluding that the Commission no longer had jurisdiction over the adjudicatory proceeding, that TMIAs motion did not meet the requirements for reopening a closed record or for staying a license transfer, and that this license transfer did not require a new certification under section 401 of the Clean Water Act. The Memorandum and Order denies the petition.
(Subsequently, on August 31, 2021, the Secretary signed the Memorandum and Order.)
