Items of Interest Week Ending FEBRUARY 26, 2021 NRC Granted a Notice of Enforcement Discretion to the Donald C. Cook Nuclear Plant, Units 1 and 2 On February 28, 2021, the NRC staff granted a Notice of Enforcement Discretion (NOED) to the Donald C. Cook Nuclear Plant, Units 1 and 2 (Cook), at the request of the Indiana Michigan Power Company (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML21063A568). This NOED allowed for the repair to a failed bus structure due to water intrusion into the housing enclosure and to perform necessary post maintenance testing avoiding an unnecessary reactor shutdown without a corresponding benefit to public health and safety or the environment. The condition causing the need for this NOED was corrected and the NOED terminated on March 2, 2021.

NRC Hosted Public Meeting on the Commission Policy Statement Regarding Education for Senior Reactor Operators and Shift Supervisors at Nuclear Power Plants On March 3, 2021, the NRC staff hosted a public videoconference with industry representatives to discuss the application of the Commission Policy Statement, Education for Senior Reactor Operators and Shift Supervisors at Nuclear Power Plants; Policy Statement (54 FR 33639; August 15, 1989) (ADAMS Accession No. ML21048A210). Specifically, the NRC and industry representatives discussed the goal of a diverse mixture of education and experience among operators. There was a closed portion of the meeting to specifically discuss a proprietary revision to Institute of Nuclear Power Operations operator selection guidelines. Industry representatives stated that the revision should reduce the administrative burden of reviewing an applicants qualifications while continuing to select high-quality licensed operator applicants.

The staff will now complete the review of the guidelines to ensure that they comply with regulations and fulfill the Commission Policy Statement.

NRC Hosted Public Meeting Regarding AP1000 Direct Final Rule On March 3, 2021, the NRC staff held a public meeting with Westinghouse Electric Company LLC (Westinghouse) to discuss their 5-year extension request for the AP1000 Design Certification (DC) and the associated NRC rulemaking effort (ADAMS Accession No. ML21060B427). The rulemaking would extend the period for which the AP1000 DC is able to be referenced by a combined license (COL) applicant from 15 to 20 years, resulting in a new expiration date of February 27, 2026. The meeting centered on the submittal that is planned by Westinghouse that will illustrate how: (1) the five identified design issues have been corrected based on current Vogtle AP1000 construction, and (2) the DC document would be marked-up in accordance with those changes. This information is needed by the NRC staff in order to proceed with a direct final rule and the 5-year DC extension they will need to ensure a complete AP1000 design per Title 10 of the Code of Federal Regulations (10 CFR) 52.54, Issuance of standard design certification.

NRC Accepts Licensing Topical Report on BWRX-300 Design for Review On March 4, 2021, the NRR staff accepted a licensing topical report (LTR) from GE-Hitachi Nuclear Energy Americas, LLC (GEH) for their BWRX-300 design as part of their pre-application activities (ADAMS Accession No. ML21048A244). This new LTR entitled Advanced Civil Construction and Design Approach (ADAMS Accession No. ML21020A137), describes the proposed design, analysis, and monitoring guidelines and requirements for construction of a BWRX-300 Small Modular Reactor. The NRC staff will review this LTR and associated technical information and will draw conclusions regarding the acceptability of the method for use during GEHs future licensing activities in accordance with 10 CFR Part 50 or 10 CFR Part 52, as applicable. The NRC staff plans to complete the technical review by December 23, 2021.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending MARCH 5, 2021 NRC Hosted Public Meeting on New Reactor Licensing Rulemaking On March 2, 2021, the NRC staff conducted a Category 3 public meeting on the Alignment of Licensing Processes and Lessons Learned from the New Reactor Licensing rulemaking. The NRC staff's slides are available at Agencywide Documents Access and Management System Accession No. ML21048A038. The meeting was conducted via teleconference and was attended by approximately 62 stakeholders representing the industry and the public. The NRC staff provided a status update on the rulemaking effort and presented an overview of the regulatory basis document that was published in the Federal Register for public comment on January 29 (86 FR 7513). The comment period closes on April 14, 2021, and the NRC staff will evaluate comments for developing the proposed rule, which is currently scheduled to be sent to the Commission by May 2022.

Office of Nuclear Security and Incident Response (NSIR)

Items of Interest Week Ending MARCH 5, 2021 NRC Staff Participated in Insider Threat Meeting On February 25, 2021, the NRC staff participated in a meeting of the Nuclear Energy Institute (NEI) Insider Threat Program (ITP) Working Group. Participants included representatives from reactor licensees that currently participate in the Voluntary Security Clearance Program (VSCP) to receive pertinent classified information from the NRC on as-needed basis. The purpose of the meeting was to discuss the National Industrial Security Program Operating Manual requirements for each VSCP participant to establish an ITP.

NRC Staff Participated in Cyber Security Workshop From March 2-4, 2021, the NRC staff participated in the 2021 Virtual NEI Cyber Security Implementation Workshop, which included over 140 participants from government, the national laboratories, and industry. The NRC staff participated in multiple discussions on lessons learned from the cyber security full implementation inspections, cyber security supply chain, and upcoming changes to the power reactor cyber security inspection program. The conference also included a keynote presentation by Department of Homeland Security staff on cyber security best practices and a briefing titled Vulnerabilities and Patching: Decision-making Process at National Labs.

Items of Interest Week Ending MARCH 5, 2021 Decision Issued on Differing Professional Opinion On February 25, 2021, the Director, Office of Nuclear Regulatory Research (RES) issued a decision on a Differing Professional Opinion (DPO) submitted on August 5, 2020, regarding the NRCs implementation of Regulatory Guide (RG) 1.183, Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors. Specifically, the DPO submittal raised concerns with the approach the staff uses to implement this guidance to assess the radiological consequences of design basis accidents. On January 19, 2021, an Ad Hoc Panel (Panel) provided the results of its independent review of the DPO to the Director of RES.

The Director of RES agreed with the Panel's conclusions and recommendations which identified improvements to regulatory guidance to support review consistency. The DPO case file can be found at Agencywide Documents Access and Management System Accession No. ML21067A645.
