Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending NOVEMBER 27, 2020 U.S. Nuclear Regulatory Commission (NRC) Hosted Public Meeting with Technical Specification Task Force On November 19, 2020, the U.S. Nuclear Regulatory Commission (NRC) and the industry-led Technical Specifications Task Force (TSTF) conducted a regularly scheduled quarterly meeting (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20314A038). Discussions included expanding the use of web-based online submissions to the NRC to include consolidated line item improvement process traveler adoption license amendment requests (LARs). Other topics included development of industry guidance for improvements to the technical requirements manual and industry plans for coordinated LAR submittals for licensee adoption of several approved travelers. The next TSTF quarterly meeting will take place in February 2021.

NRC Issued Order Approving Indian Point License Transfer On November 23, 2020, the NRC issued an order (ADAMS Accession No. ML20297A341) approving the transfer of the Indian Point licenses from Entergy Nuclear Operations to Holtec International, as owner, and Holtec Decommissioning International, LLC (HDI), as decommissioning operator. The NRC order is effective immediately, but the license transfer will not be finalized until after Indian Point Unit No. 3 is permanently shutdown and the completion of the transaction between Entergy, Holtec, and HDI which is projected for Spring 2021. At that point, the NRC will amend Indian Points licenses to reflect the completion of the transfer.

Additionally, several hearing requests are currently pending before the Commission. The transfer approval is subject to the Commissions authority to rescind, modify, or condition the transfer based on the outcome of any subsequent hearing on the application.

NRC Approved Regulatory Exemption Related to the Use of Indian Point Decommissioning Funds On November 23, 2020, the NRC granted an exemption (ADAMS Accession No. ML20309A788) to HDI for its request dated February 12, 2020 (ADAMS Accession No. ML20043C539), to use Indian Point Unit Nos. 1, 2, and 3 nuclear decommissioning trust funds for spent fuel management and site restoration activities and to make these withdrawals without prior notification to the NRC under Title 10 of the Code of Federal Regulations (10 CFR) 50.82(a)(8) and 10 CFR 50.75(h)(1)(iv).

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending NOVEMBER 27, 2020 NMSS Staff Issued Revisions to the Certificates for the TRUPACT-II and HalfPACT Transuranic Waste Transportation Packages On November 23, NMSS staff issued a revision to the certificates of compliance for the TRUPACT-II and HalfPACT transuranic waste transportation packages, Docket Nos. 71-9218 and 71-9279, respectively. The revision included adding machine-compacted waste as allowable contents as well as changes to the criticality control overpacks (CCOs) design. The revisions to the certificates are necessary to support the near-term packaging of waste for future transport to and disposal of the contents of approximately 22,000 CCOs at the Waste Isolation Project Plant. Following a detailed safety focused review, the staff issued the approvals.

U.S. Environmental Protection Agency Issued Permit to NRC Licensee Powertech (USA)

Inc.

On November 24, 2020, the U.S. Environmental Protection Agency (EPA) issued the final Class III and Class V Underground Injection Control (UIC) permits and a Safe Drinking Water Act aquifer exemption to Powertech (USA) Inc. for the Dewey-Burdock uranium in-situ recovery (ISR) site near Edgemont, South Dakota. The U.S. Nuclear Regulatory Commission (NRC) issued the uranium source and byproduct material license for the Dewey-Burdock ISR facility to Powertech Inc. in April 2014. The issuance of the Class III UIC permit authorizes the construction and operation of the Class III uranium ISR injection wells in Burdock Wellfields 1-10 and Dewey Wellfields 1-4. NRC and EPA will continue to communicate to ensure effective implementation of their respective requirements for the Dewey-Burdock ISR facility.

Naturally-Occurring and Accelerator-Produced Radioactive Materials: Petition for Rulemaking; Part 30 of Title 10 of the Code of Federal Regulations (10 CFR) PRM-30-66, NRC-2017-0159; NRC-2017-0031)

On November 27, 2020, the NRC published a notice in the Federal Register (85 FR 75959) announcing that it will consider in its rulemaking process issues raised in a petition for rulemaking submitted by Matthew McKinley on behalf of the Organization of Agreement States.

The petitioner requests that the NRC amend its decommissioning financial assurance regulations for sealed and unsealed byproduct material not listed in a table that sets out radionuclide possession values for calculating these financial assurance requirements. The NRC will also examine ways to make the tables values and other NRC decommissioning funding requirements more risk-informed. The docket for the petition for rulemaking, PRM-30-66, closed on November 27, 2020.

Miscellaneous Corrections; Correction: Final Rule; Correcting Amendment; 10 CFR Chapter I (Regulatory Identifier Number (RIN) 3150-AK48; NRC-2020-0179)

On November 25, 2020, the NRC published a notice in the Federal Register (85 FR 75230) correcting a final rule that appeared in the Federal Register on October 16, 2020 (85 FR 65656),

and became effective on November 16, 2020. That document inadvertently replaced an outdated Executive Order with an incorrect reference. This corrects the reference to the Executive Order in the final rule. This correction is effective on November 25, 2020.

List of Approved Spent Fuel Storage Casks: NAC International, Inc. MAGNASTOR Storage System, Certificate of Compliance No. 1031, Amendment No. 9; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 (RIN-3150-AK50; NRC-2020-0166)

On November 23, 2020, the NRC published a notice in the Federal Register (85 FR 74595) confirming the effective date of December 7, 2020, for the direct final rule that was published in the Federal Register on September 22, 2020 (85 FR 59395). The direct final rule amends the NRCs spent fuel storage regulations by revising the NAC International, Inc. MAGNASTOR Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 9 to Certificate of Compliance No. 1031. The effective date of December 7, 2020, for the direct final rule published September 22, 2020, is confirmed.
